Apart from the very annoying illegal practice of compelling desperate suspects to negotiate their way out of police detention through bribery by the Nigeria Police, another similarly illegal practice that must be campaigned against is the practice of arresting people in place of a suspect.

So, Mr. A is suspected to have committed a crime. He is currently at large.

The Police is supposed to follow his track, find him and bring him in to answer for his crimes.

Rather than do this, they elect to arrest his helpless mother, or wife, or children or friends who have no connections whatsoever with the crime.

By the provisions of Section 7 of The Administration of Criminal Justice Act 2015, a person shall not be arrested in place of a suspect. Section 9(5) of the Anambra State Administration of Criminal Justice Law 2010 also has similar provisions .

There is absolutely no excuse available to the police for this practice. They cannot even fall back on Section 24 of the Police Act (which provides for arrest on reasonable suspicion) to justify this travesty. Vicarious liability dose not apply to criminal cases.

SOLUTION :

The best way to discourage the police from continuing with such unlawful arrests is by insisting on filing fundamental rights enforcement actions against them in court.

DON'T KEEP QUIET. LET THEM EXPLAIN WHY THEY CHOSE TO USE YOU AS A BAIT TO CATCH THE FISH. LET THEM EXPLAIN THEMSELVES IN COURT!

I don't trust them at all...
