Asset Declaration: Saraki seeks enforcement of rights at Abuja Court

Sequel to the ruling of a Federal High Court in Lagos that it has no jurisdiction to entertain a suit by Senate President, Dr. Bukola Saraki, seeking the enforcement of his fundamental human rights, the nation's number three citizen, has approached a Federal High Court Abuja to rule on the suit. 

In a suit file on Friday by Saraki's counsel,  Prince Ajibola Oluyede, the Senate President is urging the court to grant him seven reliefs especially as it relates to the enforcement of his fundamental human rights in the ongoing Code of Conduct Tribunal (CCT) he is currently facing.
Joined as respondents in the suit are the Attorney General of the Federation, the Economic and Financial Crimes Commission (EFCC), Inspector General of Police, Independent Corrupt Practices Commission (ICPC), Code of Conduct Bureau and the Code of Conduct Tribunal.

Other respondents named in the suit with the number FHC/ABJ/CS/905/2015, are Justice Danladi Umar, Messrs. Ataedze Agu Adza, Sam Saba, Mohammed Diri and M.S. Hassan. 
While urging the Court to declare the on-going arraignment and trial of Saraki before the Code of Conduct Tribunal as falling short of the requirement of Article 3 of the African Charter on Human and Peoples Right, the suit also stated there is an apparent pursuit of a pre-determined agenda for the humiliation and conviction of the Senate President.
Part of the suit also seeks the declaration of the court that any further invitation, arrest, harassment, persecution or prosecution of the Applicant by or before any of the respondents as a breach of the Applicant's fundamental rights to a fair hearing within a reasonable time. 
Oluyede also compelled the Court to issue an order restraining the AGF and CCB from inviting, arresting or prosecuting Saraki on the basis of any allegation of wrongdoing arising before or from his tenure as Governor of Kwara State between 2003 and 2011.
No date has been fixed for the hearing of the suit.

Judges are scared of handling this case, handle the case and Bubu would immediately send the EFCC (his attack dogs) .

Lot of looted funds being spent on legal tussle... Either head or tail, Saraki is truly feeling the heat..This has been his biggest battle in Nija political scene

I have said it before and will still say it again that Saraki is simply buying time as he will surely be buried politically on this one. Imagine what the desperado is trying with our Judiciary!

This man is trying all his best to make a mockery of the laws of this country.

How can someone ask a court issue an order to protect him from the law.

Saraki loses fundamental rights suit in court



The Senate President, Bukola Saraki lost another legal battle Friday as a Federal High Court in Lagos, struck out a suit filed by him to seek the enforcement of his fundamental human rights.

The presiding Judge, Justice Ibrahim Buba in a short ruling, declined jurisdiction to entertain the suit.

Saraki had in his suit through his lawyer, Mr Ajibola Oluyede, on Sept. 30 asked for the protection of the court to guarantee his fundamental rights against “political victimization”.

Joined as respondents in the suit are: The Attorney General of the Federation, the Economic and Financial Crimes Commission,EFCC and the Independent Corrupt Practices Commission, ICPC.

Other respondents are: Inspector General of Police, Code of Conduct Bureau, Code of Conduct Tribunal and Justice Danladi Umar.

Also joined are: Mr Ataedze Adza, Mr Sam Saba, Mr Mohammed Diri and Mr M.S Hassan.

Before now, Oluyede had brought an ex-parte application before the court, but Justice Buba ordered that the respondents be put on notice.

The Judge also raised the issue of jurisdiction and ordered counsel to address him on whether it had jurisdiction to hear the suit or not.

When the matter came up, Counsel to Saraki informed the court that all parties to the suit had been respectively served with the court processes.

Buba however, told counsels to address the court on the issue of jurisdiction.
