For these wailers who fail to understand, the tribunal and inec are separate entities... The tribunal is a judicial body set aside to adjudicate election disputes. Saying that, it means that being a judicial body m, it can intervene in intra party affairs .. The petitioners case here was simple: The respondent is not a recognized candidate of the party abd as such should not have fielded as the flagbearer in the election. The petitioner was able to prove that such act was a breach of protocol and as such yhe candidacy was null and void. In other words, PDP never presented a Candidate and as such all votes won by their party was null and void... In all fairness, the APC won this case and I think even the supreme court will uphold this decision.. |

The case of tribunal sitting outside the state for some reasons is legally allowed in the constitution but in the case of holding primary election outside the state is against electoral laws and not constitutional. |

UMAR GARBA HAS BEEN VINDICATED. I remember when d then Acting Governor, Umar Garba was schemed out by d party big-wigs who shifted d primaries to Abuja because they knew if they held d primaries in Taraba state d delegates would vote 4 him. He warned them dat dis could happen but they were blinded by their usual impunity. dis is indeed a big blow to impunity & a giant stride by d Nigerian Judiciary. |
