You mean somebody that came second in an election cannot be declared winner under any circumstances? Go and study the Electoral Act very well.

The prof of law SAGAY and AGBAKOBA are right.........FESTUS KEYAMO ever since he resume playing the master billing he is never serious any more ,a case study withdrawal from TIMI SYLVA vs EFCC corrupt case through power from above and now supporting the automatic take over of the deputy as the substantive governor candidate where does it happen before when election was inconclusive.............the best option for both side is a fresh election subsequently INEC/NATIONAL ASSEMBLY will work out an amendment for electoral act and constitution amendment respectively to cover the LACUNA

The INEC rule that election is inconclusive, if the number of votes cancelled and, or where elections had not taken place, is more than the difference between the two leading parties/candidates is incurably faulty.
Registered voters for now, does not translate into persons with intent to vote in any election, registered voters with intent to vote, are those that have collected their PVC (permanent voters card).
Those with PVCs are persons assumed to be potential voters, while those registered, but without PVCs are out of the game. Out of the 49,000 registered voters, how many have collected their PVCs? Is the number of registered voters with PVCs amongst the 49,000 registered voters enough to render the election inconclusive? INEC has its job cut out here, they have to dig deep, or else the Courts should help them.
Was Kogi state gubernatorial election wrongly declared inconclusive?

The minimum requirement for participating in an election is the position of a valid voters card. The election has to be declared inconclusive because the votings strength of the affected polling units is capable of affecting the outcome of the election. The Returning officers action was in order.

You have a point here, however, wether all the registered voters in those affected areas collected their PVC or not, the rule of the game as it stands today said "REGISTERED VOTERS " and not 'Voters with PVC'. I think going forward, it should be amended to be 'Voters with PVC' rather than "REGISTERED VOTERS " because a voter without a PVC is not eligible to vote, since INEC have insisted from the 2015 General election that only PVC MUST be used as against 2011 General election when TVC was used. I think by 2019 General election, INEC should effect the change.

Can a party without a candidate participate in an election? As it stands the APC lost its candidate before the conclusion of the Kogi state election, can the APC participate in the supplementary election without a candidate?

Show me section of d elecoral act that said;a 2nd Runner up can b declared d winner of d election if d winner dies.
