The fact is no decision or option opened to both the APC and the INEC in this scenario is aptly captured by both the Act and the Constitution. If we want to in any case go by the application of either the Act or the Constitution here, we will only arrive at what seems to be the closest to the provisions of both the Act and the Constitution in the situation on ground. Going by this, neither the APC's nor INEC's decision seems to favour Yahaya Bello in this situation as he doesn't seem to come any closer to the provisions of both legislations. According to the provision of the Electoral Act and INEC's Guiding Rules in announcing the winner, the candidate that polls the highest number of votes and that satisfies the requirement of 25% of votes cast in all the local governments of the State shall be declared the winner of the election on Saturday. carboblanko:abeg, read wat u typed again. So, u want to force Faleke to b running mate by force? U think Yorubas ar daft? Faleke knew d consequence of his withdrawal and d damage it can cause. He has since written INEC officially to notify it on his withdrawal and also intimate INEC in a separate letter where he picked late Audu's son as his running mate. Clevite:Yahaya Bello participated and came second behind Audu in the primaries. That's why he's the choice substitute for Audu. He met the provision of the Electoral Act. |

mart2k:Thank you for this comment. I think the best INEC could have done is to head straight to Supreme Court for interpretation that way the legality of the candidates for APC will not be questioned. INEC tuning to AGF messed the whole deal. On this case I think is a partial victory for faleke because the court sees this as a post election case and his lawyers will feed on this. APC goofed on this, they shouldn't have interfered through the AGF. This is just my take on this. 1 Like |

ExInferis:No it is same all over the world, the no of party faithfuls that vote for the party no matter the Candidate is small compared to voters who vote because of the candidate. I still maintain that allocating that vote to Bello is disenfranchising most of Kogi voters 1 Like |

cktheluckyman:I don't know much about electoral law but d late Audu contested in the party primaries not his running mate. It would ave been diff if he also contested and got votes from party delegates; in that cirumstances we can say his votes must count.
