The seller still owns the goat given that it did not receive a monetary equivalent for the product (goat) it wanted to sell.

The buyer is at loss because he allowed his money get eaten by the product (goat) it wanted to buy. Basically, the buyer is at double loss as he loses both his money and the goat while the seller walks away back home with his goat.

According to section 1(1) of the Sale of Goods Act
A contract of sale is one whereby the seller transfers or agrees to transfer the property in goods to the buyer for a MONEY CONSIDERATION, called the price.

Furthermore, Section 28 of the Sale of Goods Act says
Unless otherwise agreed, delivery of the goods and payment of the price are concurrent conditions..i.e the seller must be ready and willing to give possession and the buyer must be ready and willing to pay the price..

There was no contrary agreement as to when payment nd delivery should take place, so it is presumed that the intention of the parties was for payment and delivery (of the goat) to be concurrent.

Seller was 'ready and willing' to make delivery..

Buyer was NOT 'ready and willing' to pay the money consideration since it's been eaten..

Money consideration was not given to the seller..
There was no sale..
Title in goat was not transferred..
Seller remains the owner..

And even if is 5k note the buyer will notice immediately before the goat chew it no matter how distracted(Nna this is money we are talking about). TECHNICALLY, D SELLER STILL OWNS D GOAT, BUT THE BUYER HAS TO BE COMPENSATED FOR DAMAGES...EITHER WITH CASH OR PREFERABLY THE GOAT. SO THE BUYER ACTUALLY OWNS THE GOAT
