The Court of Appeal sitting in Abuja has fixed Tuesday for judgement on Gov wike appeal following the Election tribunal which nullified his Election in October. You will Recall that the appealate Court has nullified the 3 senators representing Rivers State in NASS.Also 12 members of the House of Rep have been shown the way Out. If it goes against Wike, he will further proceed to the supreme court. It is instructive to note it usually terminated at the courts of appeal, but when the PDP lost ekitit, osun and Edo to the courts, they used their majority in the NASS to amend the contstitution and the electoral Act to now make the supreme court the final arbiter in gubernatorial election cases and the court no longer has the power to declare a winner to be sworn in but to order a re.run. masseratti:The guy told you the absolute truth. Only election cases involving members of legislative arm in Nigeria end at Appellate Court. Gubernatorial and Presidential election cases end at Supreme Court of Justice. |

We should be moving forward and not backward. If they do a re-run, he will surely win but not with GUN and intimidation as they did in April. Aussie:your observation is right but the last part have been put on hold due to a court ruling which is yet to be overturned by a higher court. I think the case involves Labour party in Ondo, the judge ruled that the NA can't enact a law forbidding the court to declare a final ruling(winner) in an election matters, that it's not consistent with the spirit of the separation of powers, so the electoral act is to that extent declared void. No one is yet to appeal that ruling, so as it stands, the court can declare a winner. Thanks. 1 Like |
