interesting development. Almost all the election for governorship in south south upturned. Does it mean there was a free and fair elections devoid of rigging in the north. Cos I'm yet to hear any one upturn due to irregularities in the north or any of APC strongholds.
These continous precedence creates a lacuna for the conspiracy theorist to thrive brandishing this present government as hostile to the south south. and as each day passes, their conspiratory claims is gaining wider acceptance because no evidence is refuting such claims rather, the evidences further buttress those claims, hence making it appear valid.

centvin008:
A five-man Court of Appeal panel sitting Abuja has upheld the ruling of the gubernatorial election tribunal in Rivers state. In a 110-page ruling delivered by Justice M.B. Dongban-Mensem the Court ruled that the election of Nyesom Wike did not conform with the electoral act. The Court has ordered a rerun in 90 days.

In delivering a final ruling the Court of Appeal decided all the seven issues raised by Governor Wike against in favour of Dakuku Peterside and the All Progressives Congress party.

The appellate court refused to discard the findings of a lower tribunal saying the number of witnesses is not the main issue but evaluation of the strength of evidence before the trial court.

Issue one on fair hearing resolved for the APC candidate, Dakuku

The appellate court also stated it has evaluated the guidelines of the Independent National Electoral Commission and holds them sacrosanct.

The Court of Appeal said it agrees that gubernatorial election was marred by wide-scale violence.

On issue two regarding competence of ruling by the new chairman in the lower tribunal, stamps, issuance of service and jurisdiction, the court ruled it was in order.

On issue three about locus standing to institute the case at the tribunal in 21 days, the issue was again resolved in APC's favor.

The court described the People's Democratic Party (PDP) and its candidate, Wike as crying more than the bereaved

Issue four on INEC manuals, guidelines and non-compliance including non-issuance of pre-hearing notices by the chairman of the lower tribunal, court resolved in APC's favor saying it was immaterial.

Issue five is on the reliance on documentary evidence by the tribunal resolved for APC

On issue six as to whether the lower tribunal was right on card readers, the appeals court said in the evaluation of the evidence before the tribunal after a thorough analysis of the subject matter of card readers, and its use, the lead judge stated categorically that card readers guarantees credible elections.

The Court stated that INEC manuals were consistent with the provisions of electoral Act.

http://saharareporters.com/2015/12/16/court-appeal-sacks-governor-wike-rivers-state

The facts that the court resolved that the Card Reader was consistent with the Electoral Act, and that INEC's Rules, Guidelines, and Directives are held sacrosanct, are the most significant aspects of this judgement, IMHO.

They will help towards sanitizing future elections and help achieve mostly free and fair electoral processes in this country.

To me, I cannot envisage a situation where the Supreme Court would go against this classy judgement.

Bring on Electronic Voting Systems, please!

Rivers Election is going to be a great battle between the lion & the tiger..we shall see how the thing will go..let there be free & fare election nothing more Nothing less...the state is a cash cow for PDP already but I doubt if they can sustain their " arucushanca" victory

let those concern go to court if they have enough evidence to support their case. Have u forgoten that late Yaradua former president said the election that brought him to power war rigged. Pdp has been rigging elections for years and that why they believed they will rule for 50yrs.

If Wike buys time by going to supreme Court and eventually wins a credible re-run election, then APC wld have only extended his run as a governor.

If Wike buys time by going to supreme Court ....

1st fact is that according to the electoral law, all cases on election matters end at the appeal court.

As such, this is the last bus stop as far as this case is concerned.

Wike should go and donwhat he knows best and teach APC
