Good evening esteemed members of this great forum. Ladies and gentlemen,I present to you THE NAIRALAND INTER-SCHOOL DEBATE. This is the 7th round of this entertaining and educative event. A few schools have made it to the next round already while a few others are still sharpening their swords and shining their armours to battle it out so they can make the next round. Let me quickly introduce to you the schools we have this evening who will tug it out in this intellectual showdown. On the supporting side we have one of the best polytechnics in Nigeria. PROCEDURES 6:55 -- Debaters and judges (Rocktation,Adeaks and Crazyman) register presence 7:00 – The organizer, Fynestboi declares the debate open 7:00 - 7:30 -- Debaters post their arguments within 30 minutes, maximum word limit is 1000 7:30 – 8:30pm – Rebuttals - A debater takes on his opponent’s view, puncturing his or her points - This the debater does by quoting the said comment and then countering it with his or her own views. 8:20 – 8:40pm – Judges post questions to debaters either on what the debater has posited or revolving around the debate topic, albeit, this is not compulsory, it is acceptable for a judge not to have questions for the debaters... Judges with questions should please be specific as to which debater they are posting their questions to. E.g “Mr X, could you expatiate what you meant by subsidy? or ...., kindly give examples to your claim that the removal of fuel subsidy is justified. 8:40 – 9:00pm – Debaters respond to questions raised by judges 9:00 – 9:20pm – Two questions will be entertained from the audience i.e. viewers and this will be based on ‘fastest fingers’. After the 2 questions, other questions will be attended to after the debate or perhaps, if the debater is free during the debate to respond to them, he or she can do so, however, points will not be awarded after the 2 questions. 9:20 – 9:30pm – Debaters respond to audience questions and concludes their arguments. The concept of human rights has become a global issue. The principles that all men and women are created equal has become the foundation of all Democratic societies. It has been observed that opinions of people based on race, personal belief or societal standing form the structure of prejudice and bigotry. This has made the attainment of equal rights to remain a constant struggle -Prof. Yusuf A. I. On this note, I humbly Accord my pleasantries to the owner of this forum, Mr seun osewa, honorable unbiased judges, organisers of this intellectual combat, supermoderators, moderators, well-learned opponents, ever supporting Nigerian students and all niaralanders viewing. I am joejonah by moniker, the first representative of auchi polytechnic, auchi. I am here to register my stance that the Nigerian constitution, on fundermental human rights was not drawn up to take advantage of our right rather to protect and defend our rights, with my enlisted points below. As noted by Chafe, (1994:131), the primary requirement for debating anything is to understand first and foremost the critical thing being talked about. No one is likely to dispute the suggestion that the elementary facts is often being taken for granted particularly as it relates to debate on fundermental human rights. Human rights, also called natural human laws has been flagrantly used, abused as well as paraded under all sort of interest and guises. It is however, defined as in line with the context of Nigerian constitution as a set of legal protection in the context of a legal system wherein such system is itself based upon the same set of basic inalienable rights; such rights thus belong without presumption or cost of privilege to all human being under such jurisdiction. While, To take advantage of something, is to “use an opportunity to get or achieve something”. In the light of the above, let us consider the situation surrounding the emergence of fundermental rights in Nigeria. Perior to the inauguration of civilian administration in may 1999, Nigeria human right record was nothing to write home about. Mainly because of long years of military dictatorship. After president Obasanjor inauguration, the government ceased to use military tribunal on civilian and announced the release of political prisoners and detainees in line with the prescription of our fundermental human right constitution. Under this tensed conditions you should not have expected the most important part of the Constitution (human right part), to be compromised, thereby taking advantage of our natural right. Moreover, Nigerian fundermental rights share a great number of similarities as could be seen in world power countries as United Kingdom, United States, France, Brazil etc. Can we also say that their entire human right is being compromised and being taken for granted? No. Will be the right answer. It should also be noted that for a constitution to gain acceptability by the people there must be obvious involvement of all stake holders in fashioning it's content. There must be adequate and effective consultation of all sector (IDEA, 2003:26-27). in the light of this we can all affirm to it that our fundermental human rights portion of the Constitution is to protect us. Conclusively, that the fundermental human rights has its limitations with the exception of so called non-derogable human rights ( the four most important are the right to life, life free from slavery, life free from torture, and life free from retroactive application of penal laws), most human rights can be limited or even pushed aside during times of war, it could also be limited by level of education, poverty, and religion. But this does not mean the entire human rights in Nigeria is drawn to take advantage of the people it was drawn for. If it was so, associations as national human rights commission (NHRC), human right monitor (HRM), human right law service (HURILAWS), and youth for human right protection and transparency initiative (YARPTI) would not have existed. Finally, it should be noted that if someone, group of persons or even government walked on our right, it is on us as a duty to put it upon ourself and fight for our right as prescribed by our Constitution and that is why our eyes need to be opened to the provisions of the Constitution and not assume it to be designed as a conspiracy against us. Good evening Mr. Chairman, the moderator, panel of judges, my co-debater and distinguish fellow nairalander reading at home. I am by name ehisdan, the second speaker representing Auchi polytechnic Auchi. I write to support the notion: ‘’According to the Nigeria constitution chapter 4 sections 33 to 46 which talks about fundamental human rights, has our constitution been drawn up in such a way as to protect or to take advantage of our right?’’ First and foremost I like to state some definitions of fundamental human right by imminent personals. According to Forsythe (2000), human rights refer to the supposed basic rights and freedoms to which all humans are entitled Murray (2006), explained human rights as a condition in which person’s ownership rights to his body and legitimate property rights are neither invaded nor aggressed against by person, group of persons, or government Human rights is a concept which regards human beings as having universal rights, or status, regardless of legal jurisdiction, and other localizing factors, such as ethnicity and nationality (Wikipedia, 2006) Now the fundamental human rights according to the Nigeria constitution are: Right to life Right to freedom, from torture, inhuman or degrading punishment i.e every individual is entitled to respect for the dignity of his person Right to freedom of movement Right to private life and family life Right to freedom of association including political parties Right to acquire and own immovable properties in anywhere in the country. Properties either movable or immovable shall not be taken possession of compulsorily without compensation Right to freedom from discrimination on the ground of sex, race or tribe, creed or political opinion. Right to fair and equal hearing Right to freedom of expression and the press Right to freedom of thought, conscience and religion Right to freedom from slavery and forced labour Right to freedom from unlawful imprisonment Right to vote and be voted for in any given election Right to education Right to work and receive commensurate compensation Right to hold public office From the constitution it can be clearly seen that the fundamental human right law is to protect the citizen of the nation and not to take advantage of them. As seen in the first law “Right to life”. Every citizen has the right to live; no one should take the life of his fellow human being. Without this law our country Nigeria would have been in extinction by now, in the sense that, there will be unnecessary killing of the citizens of the nation with or without cause. Taking the case of Boko Haram insurgency as a typical example of fundamental human right as to protect the citizen of the Nation; It is the right of those people being killed to live but the so called Boko Haram group has deprived them of that freedom thereby the government is taking it upon itself to make sure everything possible is done to eliminate the insurgency and restore the fundamental human right (right to life) to the areas affected. Because fundamental human right is to protect the citizen is the reason while anyone who by anyway covet its neighbor’s property, invade its neighbor’s privacy or subject his neighbor to slavery is to face the penalty according to the law. Without this fundamental human right up till now slave trade would have still been existent. The section 35(1) of the fundamental human right states that every person shall been titled to his personal liberty and no person shall be deprived of such liberty (Right to personal liberty). This right makes it possible for individual to have a free will to life. It is liberty that makes man to become what he wants to become in life and destiny. If fundamental human rights were written or given as to take advantage of the citizen there wouldn’t have been right to personal liberty. The section 36(1) states that a person shall be entitled to fair hearing within a reasonable time by a court or other tribunal established by law and constituted in such a manner as to secure its independence and impartiality. It means no citizen shall be arrested arbitrarily. The government should adopt the due process of law be it civil or criminal action irrespective of status of the individual involved (Right to fair and equal hearing). A typical example of right can be traced to what is what is currently going on in our government today, under execution of Muhamadu Buhari( the president of Nigeria) in the case Nnamdi Kanu, Dasuki, Metuh and the likes who are currently being tried by court. We all know what would have been their fate by now if it were during General Muhamadu Bahari military regime before the amendment of the constitution in 1999 which brings in fundamental human right. If fundamental human right was to take advantage of the citizen there wouldn’t have be court hearing, court of appeal and tribunal after election. Right to freedom of expression and press: section 39(1) support this this right, which states that “every person shall be entitled to freedom of expression including freedom to hold opinions and to receive and impart ideas and information without ideas”. Subsection (2) of it makes it clear that Nigeria citizens are entitled to enjoy the rights and freedom to express their views concerning the government on economic, political and social matters without any form of intimidation from the law enforcement agents provided it is not seditious, defamatory and blasphemous by stating that “without prejudice to the generality of subsection (1) of this section, every person shall be entitled to own, establish and operate any medium for the dissemination of information, ideas and opinions provided that no person, other than the government of the federation or of a state or any other person or body authorized by the president, shall own, establish or operate a television or wireless broadcasting station for any purpose whatsoever”. Examples of this are AIT (Africa Independent Television), Silverbird Television, Channels TV etc. If fundamental human right was for to take advantage of the citizen of Nigeria there wouldn’t be private televisions, everything would have be owned by the government and public opinions and ideas wouldn’t have been heard. I believe and very sure with this few points of defense, I have been able to convince and not to persuade you that fundamental human right in chapter 4, section 33-44 in the Nigeria Constitution has been drawn such a way to protect the citizen and not to take advantage of them.
