olokfor:

An Ikeja Chief Magistrates’ Court sitting in Ogba on Friday adjourned the trial of a suspected fraudster when the accused was found to be in possession of objects suspected to be charms.

Chief Magistrate Omolade Awope had observed that the accused was feeling uncomfortable and jittery in the dock and ordered that a thorough body search be conducted on him.

Following the search, assorted objects suspected to be charms were found hidden under the dress of the 41-year-old accused, Ibrahim Umaru.

As a result of the shocking discovery, the chief magistrate deferred the trial of the suspected fraudster to June 10.

Umaru, who resides at Amodu Faronbi Street, Isolo, Lagos is facing a three-count charge of conspiracy, stealing and obtaining under false pretences.

Earlier, the Prosecutor, Insp. Ezekiel Ayorinde, had told the court that Umaru and his accomplice, Sunday Godwin, on Sept. 25, 2011 hypnotised one Okunola Salau and duped him of cash and jewellery worth N5 million.Lol

“The duo also took him home, performed magical acts on him and threatened him not to tell anybody otherwise he will die.

“Afterwards they kept on pestering him on phone to give them money and jewellery.

“Salau later gave them gold jewellery worth N4 million before he later regained consciousness,” the prosecutor said.

The accused had pleaded not guilty to the charge and had been granted bail in the sum of N1million and two sureties.

The accused had earlier been arraigned at an Ikeja Magistrates’ Court before his case was transferred to the Chief Magistrates’ Court sitting in Ogba.

Well well, in law the use of Juju is seen as an unreasonable belief, because its verification is either difficult or almost impossible.
But this stance has been viewed with opprobrium by some learned jurists especially in the area of torts...
For example in the area of Assault, if someone threatens to kill you after brandishing a rifle in your presence, he is liable for assault. The reason being that you had the conviction that your life was in danger. This is very much material. Now, the propounders of this theory opine that if a person is scared at the sight of a gun which he believes can kill him same should be compared to any man(especially in Africa) that believes that a charm waved in his face can also kill him. The notable thing here is the reasonable apprehension of fear in the mind of the victim which unsettles and jeopardises his sense of reasoning

The adjournment by the Magistrate is lawful, because the main reason for the adjournment was to arrive at a better judgment devoid of manipulations (Justice)...I read with amusement where someone commented that the Magistrate be searched also
Presiding judicial officers are so skilled in reading people's demeanour and can readily tell when you are not comfortable in the dock.

Ohemgee! Why are some people so superficial? Can't you reason that the charm has already taken its toll on the magistrate? That was why she would let go of him in the name of adjournment.

The answer is no, cos they well know the consequence of their doing so is instantanous.........
