A petition filed by James Faleke against the governor of Kogi State, Yahaya Bello, at the state’s election tribunal, has been thrown out.

While delivering the judgment on Monday, June 6, 2016, the tribunal held that Falake has no locus stand to file any petition against the election of Bello as governor and therefore dismissed his suit.

It would be recalled that Faleke was the running mate of the initial candidate of the All Progressives Congress, APC, in the Kogi guber poll, Abubakar Audu, who died shortly after the election was declared inconclusive by the Independent National Electoral Commission, INEC.

During the rerun, the APC fielded Bello as its candidate, which Faleke kicked against. He argued that as the running mate to the late Audu, he should have been the perfect replacement and not Bello.

This is a clear miscarriage of justice. Bello should never have replaced Audu. Faleke should take his case to a higher court for proper adjudication.

How is it a miscarriage oga...It has been clear from the onset that this was a dead on arrival case,The election was declared inconclusive and within that that time frame,the presumed winner died,the party was summoned to throw in another candidate and Bello was selected since he came second runner up to Audu in the primary election..Falekes case has no basis because first of all 1.He didnt participate in the primaries 2.It is a political party that selects and tenders its candidate and submits same to INEC and not the other way round. 3.The case of Boni Haruna VS APP where Atiku Abubakar was the Governor elect of Adamawa,but since he was selected by Obasanjo to be his running mate,he stepped down and Boni Haruna became Governor. This case was argued by the then APP because its only when an individual is incapacitated or dies, thats when his deputy can step up. But the supreme court ruled that the Parties interest was supreme over the candidate. Thats the more reason you see that during the period PDP held sway,a legal primary election wud be conducted,but someone in his hotel room will just draft a list and send to Inec and inec wud accept such because it carries the required stamp,seal and is duly signed.. As for Idris Wada,his case is going to be struck out too because he participated in the re run election,if he hadent participated ,he might have had a case but the fact that he participated gave credence to the whole process hence its like a man calling another man a thief,but the were both caught at the crime scene.

Faleke is a dreamer if he thinks that he can win in a court inorder to be governor.
Yahaya Bello will be Kogi governor till 2019 and will be re-elected to rule till 2023.

Bello didn't participate in the inconclusive election, so how could he be awarded the votes that both Audu and Faleke scored? Do you know that some voters voted for Audu based on the fact that Faleke was on the ticket? So, how do you transfer Faleke's votes to Bello? Bello had a paltry 6500 votes, how could he have been declared the elected governor with such abysmal number of votes?
The electoral act didn't envisage the event that led to this logjam. So, nothing is absolute yet. Falake should exhaust all legal channels to get back his mandate. This is going to push back the frontiers of our electoral laws.

no offense bro!! audu and faleke were running mates, audu and bello contested in the party's primary election, which audu won. don't forget that faleke wasn't in the picture then. Faleke was selected/nominated by the party to be audu's running mate. fast-forward to the main/general election..audu was widely believed to have won the election but at the time of his death, INEC hasn't declared him as such..mind you, it's only candidate who contested at the primaries that has/have the right to contest in the general/main election ( it's long story bro and I really sucks at typing. so try the constitution and the electoral act)..again no offense bro#amjustsaying

I am aware of all these events. One thing that baffles me is how Bello inherited Audi's votes. Do you know that some people voted for Audu because Faleke was on the ticket? How do you now separate the votes Faleke got from that of Audu? Faleke and Audu ran on a joint ticket, that means the votes that accrued to that ticket belonged to both of them. Why the votes were given to Bello is what I still find hard to understand.

The last, I am sure, has not been heard of this case. I see it getting to the highest court in the land.....The event that led to this logjam is a novel one which makes it difficult to rely on the electoral act since it is silent on what happens if a candidate dies in the midst of an election.....This case will go a long way in pushing back the frontiers of our electoral laws.
