In my own opinion, I will advice you to put him on prayer point.
Then try to renogotiate with him, cos getting another apartment will cost you more. In all try and get a property and start building, it will definately help in short time. Goodluck.

I feel sorry for your situation.

First, let me be honest with you: Majority of your problem, has to do with your Landlord!
The new owner is NOT your Landlord because he did not go into any contractual agreement with you.
It is his house and he can decide to renovate/demolish/rebuild it.

The former owner has no right to sell the house during the period ....when he has collected money from you as Rent.
That is fraudulent!
He has collected money from you for the period..he has also collected money, by selling, during the same period.

Now, if you look at the cost of building Materials... infact, the cost of everything in Nigeria, places like Lagos especially, the price of everything has more than DOUBLED in the last one year!
Now, you will realise that if l buy rice at double the price, Tomato at double the price, Transport has tripled, everyone has doubled or triple their price while claiming "DOLLAR HAS RISEN"!

So, will it be reasonable to not expect the house owner to increase his own "market product" (rent) ?
Everyone is "Selling what they have".
It is a "vicious cycle" in Nigeria when we all decide to increase the cost of items, not minding that salaries/income are not increasing.
Everybody is taking advantage of each other.


In my own opinion, your best bet will be to negotiate with your House Owner.
Even the Mediation Center cant compel him to do what you want as he will simply claim he did not rent out his house to you.

Just try and look for an alternative accommodation where the price is affordable and plead with him to give you more time.

I am a lagos resident and my landlord sold his house to a new one.

the new one has been threatening to evict us by force as this is the second time he has come with policemen, the first time, he came with a policemen from SARS ikeja when we are not robbers.

i am a paying yearly tenant with my receipt with me.
he tried to negotiate with us to pay 400k per annum upon renovation, up from 250k
we begged him to accept 300-350k (based on each tenant's pocket) or give us 6 months to leave
he said he is not ready to give us 3 months talk less of 6 months

Last week, he came around to disconnect our soakaway pipes
he erected scaffolding to remodel the house even when we still reside there.

today, they came to disconnect our nepa cables
this will be the second time.

they have issued us a notice from the mediation center but they are impatient to even wait till the date of invitation before starting to mess with us.

Op. This post was unecessary. Call a meeting with your co-tenants. Team up and get a lawyer. Sue the landlords [previous and current] for every penny they have. Claim inconveniences and damages. If cash to go to court is an issue, with diligence, you can get a lawyer to work pro bono. Nigeria is a country where the judicial system is left to wallow.

In a developed society, the man wouldn't try that stuff, because suing someone to court is like buying lollipops. Institute a legal action and he would seek for a proper out of court settlement.

Covenants on land run with the land. In other words, a new landlord inherits subsisting leases on the property and should have done due diligence to ensure he pays your former landlord less the subsisting rents.

Way forward for you: Get your lawyer to write the new landlord stating the issues and threatening legal action if he continues to disturb your peaceful possession.

Way forward for the landlord: He should issue 6 month notice to the tenants and 7 days notice thereafter. After the 7 days notice, he can then proceed to court to recover possession. Eviction is protected by law. There's no short-cut to it. Bringing SARs to threaten you won't help him. It's not a matter for the police.

Finally! Someone who actually knows the law.

Where you owing the previous landlord rent?.
Has your rent expired?.

Just get a good lawyer, sue the landlords to court. You get 6 months, 3months and an extra week before you will be forcefully ejected from your apartment.

If during this period he tampers with your apartment or properties, make him pay for it.

Just get a good lawyer and all this landlords won't mess with you.

6 months notice is what i believe the law mandates for yearly tenants

Make all the necessary move and get another apartment forget about any legal mean you will loose. Am talking to you as a Community Development Association chairman and as a landlord, you should try get another apartment urgently instead of joining issues.

Just look at what young Nigerians are saying, that tells you that our society is filled with hugely uninformed Youths who claim to be educated. Simple my dear, nothing concern you and the transaction, all you know is that you kept your part of the initial contract. Infact, start by suing for the inconveniences put to you by removing those things in your house. You pay for your light and he prevented you from enjoying it, let alone the house you paid for. If the so called landlord does not know the law, teach him the law. If he likes let him bring Arase him self, do not shake, but make sure you stay away from any trouble he can hold hands on. I can assure you if he know the law, he would not be messing the way he is doing. Again, you guys should come together and give him a legal battle. For sure, as long as the case is in court, no transaction will go on there and you will still be in the house. If the case last for 20 years, you will remain there until issues are resolved and you pay for the time you spent based on the current rent. It will be win win for you. Do not mind those bubble heads that keep telling you to go and beg, go and pray or run and look for another house. I have had such experience, my care taker was forming Kingkom, scared every other tenant away, even my next door neighbor who agreed to fight the battle with me ran. But when my care take saw what I was planning for him, hmmm, he started asking for mercy, he later allowed me to stay. I was the one that left when I decided. It is terrible that our young people whose went to school do not know one bit of the law. If it is to curse or yabb each other, they will show expertise, Tufia!

. We do not expect anything less from you CDA chairman/landlord. You will always advice tenant to look for house and leave. Even the kingdom of God suffereth violence why can't we face the reality on ground? Some landlord think they are gods they will just look for lawyers that can cut corners for them and give 7days quit notice where does that happen? Plse take the bull by the horn go to court and mediation center and seek help.

Take your new Landlord to court. That is not how to eject a tenant from a building. The law allows 6months notice. Do it now and don't waste anytime to it,what he is doing is illegal.

Ranting or no ranting cannot help situation now. What I think you should do is to renegiotiate with the new landlord and plead with him to give some months. Another option is to sue you landlord (1st) for breach of contract. You will be adequately compensated,one thing remains that the house has been sold and there is nothing you can do about it.

The new landlord takes over subject to the terms of the tenancy agreement between you and the former landlord. Since you are a yearly tenant you are entitled to six months notice to quit. Thereafter he will still be obliged by law to serve you with 7days notice to give up possession (except if the law operating tenancy in lagos is different). Without this statutory notices he cannot by sheer force of arms or any form of intimidation compel you to leave. Even after the 7days notice to quit is served and you guys don't move out(I am not encouraging you to stay over beyond your rent ooo) he cannot resort to self help. All he can do is to institute an action in court to recover possession of the house. Brief a lawyer.
