FORMER Aviation Min­ister, Chief Femi Fani-Kay­ode, has asked the Federal High Court, Lagos, to ad­mit him to bail 24 hours after he was arraigned on a 17-count charged by the Economic and Finan­cial Crimes Commission (EFCC). He also alleged that he is being pressured by EFCC to refund N84o million without trial.

In the motion for bail filed on his behalf by his counsel, Mr. Ahmed Raji (SAN), Fani-Kayode told the court that he would be ready and willing to provide a responsible surety(ies) as may be re­quired by the court as a condition(s) for the grant of his application.

He argued that under the Administration of Crimi­nal Justice Act (ACJA), bail is more relaxed as all offences are bailable “and in the class of offences charged, it is the prosecu­tion that has a burden to show why bail should be refused. More so, under the Act, all offences can be compounded by plea bargain. So, it is not about imprisonment any longer.”

He further argued that one of the co-accused in the charge, a former Min­ister of Finance, Senator Nenadi Usman, who alleg­edly received the money from government and paid Fani-Kayode, wrote that she did not know the money was from govern­ment. So, how would Fani- Kayode know?

EFCC slammed Fani- Kayode and Usman with a 17-count charge for fraud and money laundering.

Fani-Kayode was arrest­ed for allegedly receiving N840 million during the presidential campaign of former president Good­luck Jonathan.

In the motion dated June 15, 2016, Raji argued that the offences, for which his client is charged, are bail­able.

“The Defendant/Appli­cant has never been con­victed of any offence in Nigeria or any other juris­diction.

By Section 36 (5) of the Constitution of the Fed­eral Republic of Nigeria, 1999 (as amended), the Defendant/Applicant is presumed innocent until proven guilty.

“The reputation and past credible record of the Defendant/Applicant at­test to the fact that he will not jump bail if he is grant­ed same. The Defendant/ Applicant will not inter­fere with the investigation or further investigation of the charges preferred against him.

Oga FFK, you better return our money and stop the grandstanding. Metuh said more than this and today, members of his family are begging to return the money he collected just to stop his trial. Be wise now, do the needful before it is too late. Buhari got no chill, he will ensure you are jailed for the money you looted if you don't return it in time.

I read the news up there then went through the comments and I was amazed with the stupidity of 90% of those who commented. Did they actually read the post?

Nigeria is doomed if these are actually leaders of tomorrow. Their mental faculty has been corrupted with the supposed corruption crusade that they can't think straight again.

The young man is saying he is being pressured to return money without being tried to prove he took the said money illegally.

To compound the issue, the person who gave him the money said she did not know the money came from government. The question is if the giver did not know, how do you except the receiver to know?

This is a case of giving a dog a bad name to hang him.

It amazes me the way some ppl here actually yearn for an outright subversion of democratic tenets, rule of law, civility and diligence on the part of the prosecution.

It is absolutely wrong for any law enforcement agency to arrest and detain without evidence and preparedness to charge d arrested person to court. That is very unwholesome practice packed with intimidation tactics to place any person at an unfair disdvantage.

I see people here baying for blood like wolves forgetting that in the eyes of the law, everyone is presumed innocent until proven guilty and therefore entitled to goodwill and fair treatment. I wonder when young Nigerians will mature beyond blind passion and political affiliation to understand that the law is supposed to be a dispassionate and stabilising essence in any society.

They are all here demanding that money abi yam be returned but none were able to say same to Mr Daftus whose academic qualifications are in question as to suitability to contest and become president. None of those here demanding for unproven allegations have also screamed that Buhari should simply produce his certificate and put paid to allegations instead of hiring 13 SANS and 10 other lawyers to begin delay tactics. Where is that infamous integrity?

Just a bunch of cowards on this thread yet they claim to want the good of the country while the rule of law is disdainfully relegated.

Lol cheesy cheesy Wicked!! But I think, EFCC have already collected some part of that kpomo mouth because it does not rise like before anymore, and hardly talks.

Correct me if am wrong but I think despite all that has happened in this month of June that am sure the kpomo mouth would have risen to rant about, this is his first speech in the month.

Oga kayode, EFCC is doing you favor, that was d same grace they gave to your partner in crime Methu at the first place that he vowed he will never return any penny but was later begging to return the money of which d opportunity ain't there again....remembered the money u were asked to return ain't yours so don't think you are doing efcc favor by returning it but yourself and your new born baby. but if you atr confidence like Methu did in d beginning then u can let the game rolls .

To all of you talking about rule of law and subversion of justice, hear this;
It is much cheaper and stress free if it does not get to litigation in court. The UK prosecutors had to ask Ibori for a bargain to cut cost of prosecution and time wasting. Even if the cash ddnt belong to the govt in the first place, what work did he do for the giver of the cash to warrant that kind of reward. FFK is asking for a trial because he knows our justice system is crap. Our leaders are lucky that alot of Nigerians are just plain gullible.

Crap! He has a right to be tried in a competent court of law. This is not a military regime where you threaten people around. Since they can prove beyond reasonable doubt he embezzled public funds, they should take him to court.
That's the civil and right thing to do. Are we all animlas in this county for crying out loud? When did our youths stop reasoning like human beings?.
