Well Perjury is criminal but it is not the same thing as giving false declaration. Perjury is when you intentionally lie under oat. However, if you can proof that at the time, you believe same to be true, even if it is later proofed to be false, you will not be liable for perjury.! kcnwaigbo: |

op, it is glaring that your question is not to seek knowledge but to rant, so continue in your delusions since you can't differentiate between criminal charges and civil suit. also learn what plaintiff/defendants and prosecutor/accused means and it's application, therein lies your answer. Enjoy your day. 1 Like |

I would say this is a civil suit and the consequence of this is same with whether it's criminal - he leaves office. ACJ doesn't have anything to with this. Admittedly, this is a case that has civil and criminal elements and as of law the criminal elements should be decided upon first but the case was filed as a civil suit, the SC will not tell a counsel how to. Would love to hear your constructive criticism on this notion. |

jossyj: Sorry dear,Buhari has no control over the supreme court which is the final arbiter of this case.If you did not learn from the Rivers and Akwa Ibom tribunal judgements then you are on a very long thing. Besides I thought you people told us Buhari is Mr integrity so why now this boast of him controlling money and judges. |

I think we should do more research on this issue of Buhari's certificate this before making comments. Im not a lawyer, but i heard that anybody with 10 years of experience in the public sector can contest for election. On the other hand, President Buhari pass through a military school. Do you think if Buhari his not educated, he can become a military President to rule NIGERIA just like that? I even read Buhari also trained at US War College. This is a school with an equivalent certificate for masters programme if not higher. So, what are now saying...a graduate or equivalent which President and the People's General "as i call him" Buhari has. 1 Like |

Re: Will The ACJ Act 2015 Affect Buhari's Certificate Trial? by Surfboard(m): 10:12am On Jun 16, 2016 |
The ACJ Act of 2015 can't be used here, because it's not a criminal matter. This certificate issue is purely civil. I'll explain. Firstly, only government can prosecute a criminal matter in court. Where they don't want to, and a private individual wants to, the individual has to gain the consent of the Attorney-General, to be able to do so. The reason why instituting a criminal action against Buhari at this time won't hold is because the constitution protects the president from criminal prosecution. If the plaintiff in this suit can prove that Buhari doesn't have a WASC, then after Buhari may have been removed, criminal action may be instituted. One of the best ways to differentiate between civil and criminal matters is in the relief being sought. While in criminal matters, the judgment is either imprisonment or payment of a fine, in civil matters, it's more about compensation, or a return to status quo(which is the case in this certificate matter). |

southpole:who told u that?.... Remember that this offence was committed in his quest to be an elected president, if he committed the said offence that invalidates his mandate and his not immune for prosecution in this matter, many ExGovernors with such immunity lost their seat when it was discovered that illegal action took place that brought them to power and Buhari is no different. |
