A lot has been said about the recent freezing of
the account of Gov. Fayose by the "almighty"
without recourse to constitutional provision. I decided not to quickly join the charade because of the uselessness of PDP and their attempt to introduce grazing in our communities, however, It will be unjust not to lend a voice to this full blown tyranny, this state of nature, especially when it concerns a governor who have been the leading voice of the opposition and who have been standing for what is right. Apathy in such circumstance is as good as evil. What is interesting is not that those who think it is cool for the judge presiding over the "certificateless Ness" of the president to adjourn the case sine die, are now happy with this development, it appears that even Gov. Ayodele Fayose does not know the exact section which protects him. Section 308 of the 1999 constitution prohibits any form of prosecution of a sitting governor but recourse to the present case by citing that section will not be obvious to the large group of illiterate followers of Hitler. It will be difficult explaining the illegality of the freezing of the account of the Governor citing only that section. The supporters will try to make a distinction between prosecution and investigation. I have seen some of them pasting the laughable excuse from Magu. This is where the EFCC Act itself comes in and EFCC has lawyers working there. Can they explain to me the federal high court they sought powers from before freezing of the account of the Governor? This is where section 308 now comes in handy. To freeze an account, you have to come by way of motion exparte to a federal high court. Can you take Fayose to court? No Why? S.308 prevents it. Is it Fayose ' s fault that you decided to have section 308? No Those of you presently advocating for the automatic removal of section 308 without any formal constitutional amendments are comedians. So we should now delete that section from our memory simply because you want Fayose punished? How about get the section removed first, then go after Fayose? That way, those of us who are aggrieved over what the president have been done can also sue him. It is called fairness. 4 Likes |

The Immunity clause covers the President and Governor from prosecution and not investigation. Fayose's account was closed under investigation. You wouldnt want him to move money out and stall investigation. On the other note, Adamawa state Account under governor Nyako was CLOSED during an investigation process during the reign of Jonathan. |

He can choose to appeal the decision at a court of law if he so wishes. EFCC cannot freeze any account within or outside Nigeria without the express approval of the appropriate court of law. @bolded 2. Some people are magnanimously dense when it comes to rational conversation. While the OP was trying frantically to make sense out his nonsense, he already bared his gross ignorance by asking 'which court grants the order to freeze an account of a suspect'. Constitution is not what is being played here, it's the law. And while you act like you have a big brain and was making sense, you forgot that you can approach a judge in his office and collect an injunction without conveying a full house! The money was traced to that account and was frozen just like others, pls, I pray, what is so hard to understand? |
