The House of Representatives has told President Muhammadu Buhari that the Executive arm of Government which he heads has become a threat to democracy.

The House also decried what it described as “unprecedented, severe and sustained” attacks on the independence of the National Assembly and an affront on the doctrine of separation of powers, a key ingredient of democracy.

In reference to the impending prosecution of the presiding officers of the Senate over alleged forgery of the Senate Rules, the Green Chamber urged President Buhari, who it said swore to an oath to defend and protect the Constitution, to prevail on his ministers to desist from involving in actions that cripple the legislature.

The lower chamber took this position when it adopted a motion moved by Mr. Yusuf Ayo Tajudeen (PDP, Kogi) at plenary Tuesday under matters of urgent national importance pursuant to Order 8, Rule 46 and 49 of the House Standing Orders entitled “Urgent Need to Safeguard the Nation’s Democracy and Protect the Integrity and Independence of the National Assembly.”

The lawmakers specifically condemned the continuous disregard of resolutions of the House on the Kogi State House of Assembly.

In moving the motion, Mr. Tajudeen noted that the 1999 Constitution guarantees the independence of the Legislature including powers to regulate its own proceedings.

He said the House validly exercised its constitutional powers to take over the functions of the Kogi State House of Assembly, only for the Attorney-General of the Federation and Minister of Justice, Abubakar Malami to unilaterally countermand the resolution of the House.

“He was aided in that illegality by the Inspector-General of Police who used police personnel to open the Assembly,” the lawmaker said, adding: “The result is that, just five members constitute and make laws for Kogi State.”

Yea but it doesnt guarantee u power to forge rules or display impunity! That era is gone. If u are innocent of charges then u have nothing to fear

U cant in one breath say u want our institutions to work, then in another say they shldnt prosecute u if u commit crime. Thats impunity. Btw isnt it a US congress man that was sentenced to 13yrs imprisonment? Nobody is above the law

The issue of alleged forgery is strictly on legislative matters and should only be addressed by the legislators themselves. The congressman serving a jail term did not commit a legislative gaffe, his offence was outside of his congressional functions and office.

It is just like a Judge accused of being derelict in his duties or failing to give judgment within 90 days after closing arguments of parties, he is not subjected an open trial before a regular court, he is rather dealt with by the disciplinary committee of the NJC which .ay then recommend a suspension or dismissal of d erring judge.

That is how to protect the sanctity of independent institutions like the judiciary or legislature which guarantee our democracy. Otherwise a police officer accused of insubordination or even the army officers accused of mutiny ought to have been arraigned before a regular high court judge and not court martialled.

The power of d legislature to regulate its own proceedings is sacrosanct. I expect whichever judge that d matter is assigned to to decline jurisdiction.

I dont know how u reason but last i checked, forgery is acrime under the criminal code Act. Same as bribery. It is not an internal affair of national assembly! Crime is crime, no matter where its committed. So ur epistle is meaningless

You shot urself in the leg. Buhari certificate issue is in court, so saraki and ekweremadu should also go get their lawyers as well. Nobody is above the law. You dont hear buhari crying of "victimization"
