If you are yearly tenant, you get 3months notice. If I may ask, have you been paying as at when due?
Have you been served a notice earlier before this present one?
More so, that 7days notice does mean you must pack out on or before, it means he would proceed to court after expiration of the notice. My advice, get a lawyer immediately.

Since you are a yearly tenant, the right procedure is to serve you 6 months notice to quit. At the end of the 6 months if you have not paid, then he will serve you with 7 days owner's intention to recover premises, which will come from court not with chambers letter headed paper. Even if your rent has expired, u re still protected by Landlord and Tenants Law.

There is no need writing a letter. If you still want to live there, go there tomorrow with your rent and pay. If he refuses to accept it, come back and rest. Let him eject you in a proper way. And get a lawyer

If this was a law school question, many people here would fail woefully Did you all not see where his tenancy has expired. Since the lease has not been renewed, he is NO LONGER a yearly tenant but a tenant at will.
Most importantly. No one here, myself included, knows Nassarawa tenancy laws.....if one exists.....We are just going with Lagos standard. How can we even be arguing when we don't know Nasarawa's stipulation.

Good Evening fellow Nairalanders,
First of all I will apologize for not being here earlier enough to clear the air on most of the questions raised.

1.First of all when I parked in to the house I was not given any Tenancy Agreement.
2. I've never owed the Landlord, my rent expired on 21st and I was hoping to pay tomorrow which is 26th.
3. This same letter was served to all the tenants in the compound (Six of us)
3. A day before the expiration that's on 20th, I met the landlord telling him my intention to pay on 26th that the money is not yet complete, he said he's not interested in me renewing the rent that I should start looking for house.
4. Two days later he came with the lawyer to tell us that the lawyer will now be in charge of the rents and other issues. Then the lawyer served all of us same documents.
5. Other tenants have gone to meet the Landlord but to no Avail. Even one of the tenant that his rent will expire in six month time had made all plans to park out and ask the Landlord for a refund.
5. I have not met the Landlord, I want to reply to the Lawyer in writing so that I get it documented too.

6. I thank all of you for your advice. Even those who are already crucifying me.

Without reading the story i knew it was in Nigeria.

Here, it takes 1 year and 2 months to evict a tenant from your house, and those 1 year and 2 months is without rent.

Telling your tenant to vacate within 1 week only happens in a lawless country


Only a new landlord you will stay in his house that long.

With due respect to your noble self, that's not what Odutola's case says; what Odutola says is not a general sweeping principle; it's case-dependent. What is says is that if the tenancy is by parole, then the tenant can never be a tenant-at-will upon the expiration of the tenancy and the tenant is in arrears of rent; because wat makes a contractual tenant revert to a tenant-at-will is a written tenancy agreement, specifying the commencement and expiration of the tenancy.
Go and read that authority very well. I didn't cite it 4 citing case. I ve used it severally and no qualms wit it. If the OP is a yearly tenant and he is already in arrears, in d absence of a tenancy agreement, he becomes a tenant-@-will and entitled to only One Week Notice to Quit. Section 18, Rent Control and Recovery of Residential Premises Law of various States in Nigeria.

You didn't give details of your tenancy agreement. Was there any clause like 'one-year certain' or 'eviction if you do so-so'?

If there isn't, you have a case. Reply the lawyer, telling him that under Tenancy Laws, you are entitled to six months notice as long as you pay yearly. If he plays stubborn, get a lawyer.

The house i bought in Philadelphia, the original owner has been living for free for 1 year and he's doesn't pay his mortgage, guess what ?? It took them 1 year and 2 months before he was officially evicted

So you do owe him money!
Maybe your landlord is fed up of the nonchalant attitude of his tenants and wants you all out

A day before your rent was due you went to tell him that you are still looking for money and will pay the following week. Is that right?
Was that the agreement when you moved in?
You now cry foul when he rubbed you up the same way you rubbed him up
You had a whole year to look for your rent, but you went to tell him stories a day before your rent was due.

The fact is that he will get you all out one way or another and it will cost you twice as much to move into another property cos you will pay 2 years rent plus agreement somewhere else.

The people shouting get a lawyer will not pay your fees, neither will they look for accommodation for you
regardless of 1 month, 6 month or 24 month notice you will still leave the property if your landlord wants you out

There is also no guarantee that if you don't pay rent for 6 months you will still be able to afford to move to a different property because if you cheat someone, most times you wont spend the money wisely & the money wont stay in your pocket. Karma.

Go and make peace with your landlord. He is angry with you. I would be too.

It takes longer for a bank to evict a homeowner than a landlord to evict a tenant.....different laws I suppose.

THATS THE BANK AND FORCLOSURE IS DIFFERENT FROM EVICTION . FORCLOSURE YOU ARE TAKING OVER SOMEONES PROPERTY, SO THE PROCESS IS DIFFERENT.

agreed! some places 30 days. evicting a tenant is not the same thing as foreclosure!
