A man who digitally raped a schoolgirl on a bus has avoided jail.

Erick Osguedo, 21, assaulted the underage girl on a school bus in April 2013.

Another pupil filmed the attack on a mobile phone.

Despite being found guilty of putting his hand under her skirt to penetrate her without consent, Osguedo walked free from court with a suspended sentence.

He claimed he believed the girl consented to the act, but Brisbane District Court heard she tried to fight him off.

Judge Brad Farr described the sexual assault as ‘brazen’ and handed Osguedo a 12 month suspended sentence.

A victim statement read in court revealed the girl, now 17, had become a recluse after the humiliating and public assault. She said she’d self-harmed twice.

Another student, now 16, who touched the girl’s breast during the attack pleaded guilty to indecent treatment of a child. He received a six-month supervision order.
