Following media reports that the Supreme Court had reportedly okayed a retrial for Lagos State Government on the murder case of late Alhaji Kudirat Abiola, the former Chief Security Officer to late Gen. Sani Abacha has threatened to sue media houses that published this report. To this end, Al-Mustapha's attorney Prof. Daudu, SAN has on his behalf issued a statement dismissing the re-appeal as "false, malicious, and misleading". In the press statement titled 'On Motion No. SC/45/2014 State V. Major Hamza Al-Mustapha(retd): Re: False and Malicious Coverage and Publication of Proceedings in the Supreme Court of Nigeria', Al- Mustapha's lawyer stated in parts that: "The background facts need to be stated for a proper understanding of our reaction.



"Major Hamza Al-Mustapha(retd.) herein after referred to as 'our client' was unjustly convicted of the murder of Mrs. Kudirat Abiola by the High Court of Lagos State per the Hon Justice(Mrs) M.A. Dada on the 30th of January 2012 and sentenced to death by hanging. He appealed to the Lagos Division of the Court of Appeal and after complying with the procedures of appeal, he was heard and judgment was delivered by the said court setting aside the purported conviction and reversing the sentence of death by hanging. Lagos State Government initially, appeared satisfied with the judgment of the Court of Appeal but after due political consideration, it decided to appeal to the Supreme Court of Nigeria.......



"Because Lagos State Government was out time within which to appeal, not having lodged its Notice of Appeal within the 30 days precribed by law, it brought an application sometime in March 2014, inter-alia for a) extension of time within which to apply for leave to appeal against the judgement of the Court of Appeal; b) leave to appeal therefrom and c) extension of time to file Notice of Appeal. Lagos State Government dragged its feet on the application and failed to get it listed until our client requested that we i.e. his counsel petition the Chief Justice of Nigeria for a determination of that application for leave to appeal. This we did and the Supreme Court eventually fixed the 12th of January 2017 for hearing of the Lagos State application as described above.....



"On the adjourned date, Lagos State Government 's legal counsel moved his application for leave to appeal and not being opposed by our J. Daudu SAN, was granted by the Supreme Court presided by the Hon. Onnoghen Ag. CJN and the applicant Lagos State Government was directed to file their Notice of Appeal within 30 days of the date of the grant of the application. It is a matter of common knowledge that there is no appeal pending in the Supreme Court of Nigeria unless and until a Notice of Appeal is filed by the would-be appellant i.e. LASG.



"That is why our client was most disturbed by the false, malicious and disparaging reports of the proceeds in the Supreme Court described above published in print and online on the 13th of January 2017....As things stand, there is no appeal pending in the Supreme Court by Lagos State Government or any other person or agency and our client enjoys a judgment that is valid until set aside in the very unlikely event that in the future the judgment of the court below is interfered with....



"By these injurious reports and misinformation, on our client's instructions, we hereby make the following demands in redress and reparation for their malicious and false reports, which greatly injured his reputation:


i) Publication of a retraction within 24 hours of the receipt of this letter of the false, scurrilous and disparaging material in a prominent part on the front page of their respective newspapers both print and online as partial redress for the misinformation in the earlier publications.



ii) A public apology expressing remorse over the grave distress and pain that the unwarranted publications have caused our client.



iii) The sum of 20 million naira to cover the expenses of putting out a rejoinder and correction of this false and malicious impression caused by the identified.



"Take notice that if these demands are not met as requested, we shall on behalf of our client initiate legal action in a court of law for damages in the sum of N20billion for libel."
