Smooth278:kindly check through, not trying to mislead anyone. the act stated expressedly that the "power to implement is vested in the AG of the federation and must give a report on it by feb of every year to NASS" the implication of the above portion of the Act is that the states found a loophole to avoid its enforcement at the state level. If my memory serves me right, i think delta is the other state that challenged it in court. however, i dont expect that a law should be passed for citizens to get info from govt at any level. |

I think some "Acts" could be domesticated. And this depends on the nature of the Act and its position in the Nigerian Constitution. A good example is the Child Rights Act, which the states are expected to formally adopt and adapt for domestication as state laws. Issues of child rights protection are on the residual list of the Nigerian Constitution, giving states exclusive responsibility and jurisdiction to make laws relevant to their specific situations...It is also likely that this FOI is on the residual list, because if i am not mistaken, Lagos house of Assembly had sometimes ago refused passing same.... When we said restructuring is the only way out, Nigerians say corruption is their problem so the cart pulls the horse. Is this not corruption in practice. But if the the money in question was from the sweat of the people only and not a hand down from heaven will the people not ask for their money back if proper accounts cannot be presented. The greatest tragedy of our nation and in our time is to see the light at the end of the tunnel and choose to remain like rats in the dark. The Jonathan government brought us the closest to a differently structured Nigeria, one of true independence but any hope of restructuring has been quashed by this regime. No one is saying anythjng about it anymore so that the status quo can be maintained. This is the result, full blown feudalism, the people are slaves, the rulers are masters. How dare you know what goes on. This is how Nigeria has been run for sixty years and run into the ground. I said the best we will get crom this government will be superficial. No real change will happen because real change threatens them, their hold on the country, their beliefs, their way if life. So like the long nosed rat that nibbles off unwashed fingers at night by blowing soothing air to the open wound so the enormous distraction that the antanti-coruption war has been to the real issues besetting this country. But no matter how much grandstanding is done the beauty of democracy ensures that at the fullness of time an account has to be made and then we will see whether Nigeria has progressed in real, fundamental terms. |
