Even in US Replublicans refused to approve an Obama Supreme Court Justice nomination even though the judge was a man of impeccable character Here what we have with Magu is a man indicted by a DSS report for corruption trying to run the Anti-Corruption agency If Magu has any decency he will resign If Presidency does not remove and replace Magu with a courageous lawyer who respects the constitution and rule of law, Senate should block all nominations by the Presidency going forward! |

what a country imagine,the senate are know the most powerful arm of government in this country they allocate resources to themselves engage in corruption with so much impunity and stand against anyone who tries to probe them waow...dino who clearly rigged his election by altering the results is here a free man going against a man who is working hard to restore the image and dignity of this country...... what a country I blame nobody but bubu who allowed the senate election to go on without interference they are know feeling the heat,the guy who placed himself there is feeling like a king doing whatever he and his friends like and nothing will happen |

The constitution gave them the power to confirm certain appointees of government...with that power, they can endorse or decline. Wherein they decline, it becomes the disqualification of the appointee(s), and it so stands. My question now is, are you trying to feign ignorance of the provision that gave the Senate the power of confirmation, or you have a special love for the word Disqualification? |

Nigerians are daft man the senate is right. Instead the should amend constitution so they can simple impeach these clowns like president. The senate has authority to confirm the nominees of the President. The president putting them in acting capacity to spite senate is just wrong. They should be able to counter and give orders or there won't be a way to counter exuactive overreach. You guys just miss this point because you don't like them. The simple solution is for them to amend the constitution to give themselves more power and roll in recall process admendent as 2 for 1 special. |

I hope you're aware a ambassadorial nominee was rejected by the senate and the presidency re nominated him again and he was later confirm by the senate ? Please my advice for is just look for a lawyer to tell you the difference between reject and disqualify in the nigeria constitution, so to avoid disgracing yourself in a public forum kutchs: |

yarimo:I guess you are too fast. There is no harm in asking or trying to find out if I'm a legal practitioner myself. Please, read the last part of my earlier comment again. I did not opine that there is disqualification in the said provision, rather the constitutional provision gives the Senate the power to endorse or decline by way of confirmation. If the Senate rejects or declines confirmation, the appointment cannot take effect, according to the spirit and letters of the constitution. My point is, the Senate rejecting an appointment is as good as disqualifying an applicant in a recruitment process because such appointment cannot stand as far as the law is concerned. Nigeria is a lawless country that is why most citizens don't even know basic legislations. Citizens are manipulated even with basic things. Imagine our professor VP once said the Senate is not needed to confirm Magu's appointment, and so many applauded him because it played into their cards. But I asked the questions, was the professor VP sleeping when Magu's name was forwarded to the Senate for confirmation? Where did the professor VP and his erstwhile no nonsense boss draw the powers to appoint Magu as EFCC chair, if not the Act that established the EFCC? My brother, a rejected appointee continuously holding office is an illegality and is enough to initiate impeachment proceedings. Nigeria, a lawless country indeed. On your advise that I should get a lawyer to interprete disqualification, I don't think there is need for me to do that. yarimo:Nowhere in the constitution are such words as reject and disqualify used. The word used is confirmation, you may need to read the constitution thoroughly dear. When the constitution says an appointment made by the president is subject to the confirmation of the season, it means that the Senate has the power to approve or reject such appointment. It means that the technically ( if you want to use the word) that the appointee has been disqualified from serving in that capacity if confirmation is withheld. This and many others are measures mechanisms built into the constitution to check and balance among the three arms of govt. I'm surprised you are arguing this. 1 Like |

Why do you think names of ministers-nominees are sent to the Senate for confirmation? You think it's just an academic exercise? No minsyter-nominee can begin to assume his functions until the Senate has confirmed his nomination. While the president requires Senate confirmation for some of his appointments, on some others he doesn't. Appointments like that of service chiefs, SGF, his personal aides being examples. 1 Like |

I want to ask, within the period the ambassadorial nominee was rejected and resubmitted for confirmation, did he or she perform the functions of the said office? I understand your perspective. It's semantics. Disqualification and rejection are not same in the constitution both it can still be argued based on context. Disqualification does not qualify one to be resubmitted for confirmation, while rejection is not. I guess this is what you are trying to say. Let me surprise you sir, Magu's case is even worse. The Senate disqualified him and equally rejected him. On top of this, the man and his band of law breakers has committed illegality too by discharging the functions of that office even after his rejection record three times. yarimo:i cant believe anybody will keep arguing with you. From your first response I knew i was dealing with somebody that can't apply knowledge so i passed. But you kept saying the same thing that somebody re- nominated somebody so it means the Senate don't have powers. If these are the kind of youths supporting govt in power we are in trouble cos they will be acting like zombies without ability to apply the knowledge. So if you fail exam that will qualify you as a doctor for example, can you start practising as a doctor? No. You may write the exam more than 3 times and fail but as long as you are yet to pass you can't practise. Meanwhile the fact that you didn't pass doesn't mean you were disqualified or sent away from school but you can't practise till you pass. If the exam body finally says you are not trainable and they wont allow you to write exams again, can your parent say since they are the one paying school fees you shouldn't mind them but just go ahead and open a hospital? So those ones whose names were submitted a second time were finally confirmed after repeat exams and that's what makes it legal. The executive can send names as many times to senate for confirmation but until the person is confirmed if he acts in that capacity then it is illegal. So even if the Senate can't disqualify magu, magu can't act as the EFCC chair until he is confirmed so he can wait till he is confirmed before parading himself. Till then he can't be EFCC chair. This is simple common sense. You dont need to be a lawyer to know that. I know you won't still understand from your responses so far.
