THE SENATE JUST WANTS TO PUT DOWN MAGU FOR PERSONAL ANDCSELFISH REASONS AND NOT FOR THE GOOD OF THE COUNTRY. THEY KNOW THEIR ASSES WILL BE SET ON FIRE IF MAGU IS APPOINTED.

JUST LAST WEEK Osinbajo ONLY QUOTED THE CONSTITUTION AND THEY TOOK OFFENCE

» Chapter 6. Part 1. Section 171. Presidential appointments

1) Power to appoint persons to hold or act in the offices to which this section applies and to remove persons so appointed from any such office shall vest in the President.
(2) The offices to which this section applies are, namely ¬

(b) Head of the Civil Service of the Federation;
(c) Ambassador, High Commissioner or other Principal Representative of Nigeria abroad;

(6) Any appointment made pursuant to paragraphs (a) and (e) of subsection (2) of this section shall be at the pleasure of the President and shall cease when the President ceases to hold office; Provided that where a person has been appointed from a public service of the Federation or a State, he shall be entitled to return to the public service of the Federation or of the State when the President ceases to hold office.

Is magu the only man in nigeria capable of leading efcc, the constitution made it clear the president will appoint and send to the senate for confirmation and once the senate says no then you look for another person after all the senate is working with the DSS report on magu and the senate means nigeria in general.

Seeking a judicial interpretation is the best way to go. The federal high court struck down a particular section of the electoral act some years back for being inconsistent with the constitution and I believe the same will happen this time around. The EFCC act cannot be superior to the constitution of the country.
Therefore there will be no efcc ,and no Magu the only living saint'' to insist upon, cutting the nose to spite the face

If DSS advised PMB against appointment of Magu as EFCC Chairman and their advise was considered but not accepted, why will Senate now use that to reject the confirmation and meanwhile why is the executive sef insisting it has to be magu in a country of over 150m people. angry Senate na like........

So many lacuna and anomalies in our Constitution and this is why we are where we are today

The president under section 171 of the Nigerian constitution can remove or appoint a head of ministries without the Senate confirmation but the question is....what about sub ministries such as Inec,efcc and the likes?

This is where the k leg is.

This Nat'l Assembly is becoming more and more needless by the day. The same 'DSS report' that couldn't effectively disqualify the ambassadorial nominee, Justice Nsofor, who was later given a pass (after the senate even cited old age for his initial rejection), is now potent enough to incriminate magu.

Who are they fooling?

Oh imagine; it's even appointment outside the country that concerns Senate; but why has the presidency been sending all names to Senate for confirmation, ain't there suppose to be advisers to presidency on constitutional matters before they even do anything. Magu that is yet to secure a single court conviction?

Magu who is obviously not qualified for chairman of EFCC?

The Senate rejected Magu solely in the grounds of the DSS security dossier on him which recommended that Magu was not honest enough to be bestowed with such position as the head of Nigeria's corruption agency.

Go and ask why the same DSS refused to clear him.

Or do you want this same house to work against a security report?

Magu remains a nobody and the only reason the Senate rightly rejected him was based on the DSS report.

Where I think the Senate went wrong is where they held a closed door screening of Magu which the Senate said was to protect him from being exposed by the security report which Magu could not provide credible defense for himself.

Osinbanjo is just being an over busy body over this Magu issue as he just wants to use the saga to tell Nigerians he is a professor of law.

bro read between the line but intelligently,the dss not efcc wrote against magu(that is like yahoomail writing against hotmail).who will the efcc persecute?is it not politicians?but here we have it the same set of people that would be persecuted are doing point and kill, choosing who will persecute them(does that make sense to you?).the fact that they are scared of magu or don't want magu shows a red flag already.the senates should never be allowed to choose the efcc boss,NEVER.during OBJ's time the then efcc boss was a force to reckon with,and since that time we've been having vegetables and weaklings.how will you ask the devil which anointing oil he wants you to use on him and you think he won't point at power oil for you.

Thank u for this comment, you wrote like a free born with all his faculty working at full capacity because at the end of the day. its the total achievements that will be evaluated and this crisis can impede a lot of things and magu is not worth what they are willing to sacrifice for him.Time is ticking what will be their score card at the end of their tenure,that should be their priority.
