Ac Faults Lawmakers’ Decision On Vice-president by Nobody: 7:55am On Feb 10, 2010
The Action Congress on Tuesday faulted the
resolution by the Senate empowering Vice-
President Goodluck Jonathan to act as
President and Commander-in-Chief of the
armed forces.
The party added that the action of the
Senate on the issue was illegal and
unconstitutional.
In a statement in Lagos, by its National
Publicity Secretary, Alhaji Lai Mohammed,
the AC dismissed as untenable, the
argument by some senators that the
decision was based on the doctrine of
necessity.
The party insisted that the lawmakers were
not guided by law, the constitution or
convention in passing the resolution.
It said, “Section 145 of the 1999
Constitution is very clear on how a vice-
president can act as president.
The Senate cannot empower the VP to act as
president by resolution.
“What has happened today has taken
Nigeria closer to the abyss, instead of
bringing it back from the brink. All hell has
broken loose !”
According to the AC, the argument that the
British Broadcasting Corporations interview
will serve as a notification to the National
Assembly that the President is on medical
vacation is untenable.
It added that if President Umaru Yar’Adua
had thumbed his nose at the constitution by
refusing to legally transfer power to his
deputy, the Senate had simply trampled on
the constitution.
The party said the President’s inability to
write a letter to the National Assembly was
the clearest indication that he had become
incapacitated, saying that Section 144 of the
Constitution should be evoked by the
Federal Executive Council, which must
immediately declare the President
incapacitated and inform the National
Assembly to set up a medical panel pursuant
to that declaration.
The AC also warned the Vice-President not
to exercise any power on the basis of an
illegal Senate resolution.
It said, “Vice-President Jonathan should take
wise counsel and keep to the law. He should
see this Senate resolution as nothing but a
Greek Gift designed to do him in. ”

AC is trying hard to disgrace itself. Maybe they are jealous of the amount of disgust PDP has generated for itself.

They are actually saying the truth; all we need now is one of those usual court cases and the matter will be naked.

They(AC) are right but if the senate obey the constitution then we would have more problems than we already have.The best constitutional means of getting out of this crises is to impeach mr president which may have more dire consequences than asking Jonathan to act.

AC is correct but as we all know Nigeria a lawless country parading a 419 democracy as usual.
