Lawyer Asks Court To Declare Yar’adua ‘dead’ by Nobody: 12:21am On Feb 16, 2010
Another layer of controversy has being added to the long absence of President Umaru Yar’Adua from the country, as a lawyer, Peremobowei Okele, on Monday went before a Federal High Court in Abuja to seek for a declaration that the absence of Mr. Yar’Adua and the consequent abandonment of his office since November 23, 2009 constitute ‘death’, resignation or permanent incapacity.

In an originating summons which has Mr. Yar’Adua as the first defendant, the Acting President, Goodluck Jonathan, as second defendant, and the Attorney-General of the Federation as third defendant, Mr. Okele is seeking for a declaration that the absence of the 1st Defendant from Nigeria and the consequent abandonment of the functions of the President of the Federal Republic of Nigeria from the 23rd of November, 2009 constitute permanent incapacity within the meaning of section 146(1) of the Constitution of the Federal Republic of Nigeria, 1999.

He is also seeking for a declaration that by virtue of the ‘death’, or resignation or permanent incapacity of the 1st Defendant, the Office of President has become vacant within the meaning of section 146(1) of the Constitution of the Federal Republic of Nigeria, 1999.
