Barely 2 weeks after suing President Muhammadu Buhari over alleged lopsided appointments to the board of the Nigerian National Petroleum Corporation (NNPC), senior lawyer, Dr Olisa Agbakoba SAN has again approached the Court to remove the president as petroleum minister.

The senior advocate has asked the court to consider the provision of Section 138 of the 1999 Nigerian Constitution which forbids the president from holding any other executive office or drawing double payments as a public official.

Citing the fact that the president was not screened for the job by the Senate, Agbakoba urged the court to determine “whether by virtue of Section 147(2) of the 1999 Constitution, the President can hold the office of the Minister of Petroleum Resources without confirmation by the Senate of the National Assembly.”
