Alhaji Atiku Abubakar is still contesting the Presidential Election.

The presidential hopeful urged Nigerians to disregard the “rumour” that he had been disqualified from contesting by INEC.
His words: “There is this misinformation, lie and propaganda flying around that I, Atiku Abubakar, have been disqualified from contesting the presidential election. I want to tell you that I, Atiku Abubakar, have not been disqualified. I remain in the presidential race.

“Under our Constitution, INEC has no power to disqualify anybody. Under the Electoral Act, INEC, SSS, EFCC, ICPC and the police have no power to disqualify any candidate. The only authorities having the power to disqualify are the courts and the political parties.

“The Constitution and the Electoral Act do not permit agencies like INEC, the Economic and Financial Crimes Commission (EFCC), the Independent Corrupt Practices and other related offences Commission (ICPC), the State Security Service (SSS) and the police to bar candidates seeking elective offices.
“You the people can also qualify or disqualify the people you want and the people you don’t want through your votes and don’t make the mistake of voting in the garrison party under the garrison commander.

“All of us here were founders of the PDP but we left the party when it was taken over by the garrison commander. Don’t vote the PDP, it is the Poverty Development Party. It must go away.

“It is only Nigerians, through their votes and the courts, that have the power to disqualify any candidate from seeking elective office and no president nor his men or other agencies or the commissions have the right to do so.

‘The party has been turned into a huge garrison under a garrison commander,” he said and apologised to Nigerians for the “misrule” of the PDP, promising that the AC would clear the mess left behind by the PDP.

The AC presidential candidate had earlier yesterday returned from London.
Prominent politicians present yesterday at the rally were Governor Bola Tinubu of Lagos State; Otunba Niyi Adebayo, former Ekiti governor; AC governorship candidate in Ekiti State, Dr Kayode Fayemi; Mr Babatunde Fashola, Mr Rauf Aregbesola and Mr Ademola Adegoroye; Chief Audu Ogbeh, former National Chairman of the PDP; Alhaji Ghali Umar Na’Abba, former Speaker of the House of Representatives; Chief Tom Ikimi, former Minister of Foreign Affairs; and Otunba Oyewole Fasawe among others.

Ayu goes underground
Dr. Ayu, a two-time Minister in the Obasanjo administration, Vanguard gathered, yesterday, was invited by the State Security Service (SSS) for questioning, but fearing that he might be arrested, he appeared to have gone underground.

The VP’s party, Action Congress (AC), alleged yesterday that the Federal Government wanted to slam terrorism charges on Dr Ayu, saying this “is a final indicator of the return of full blown dictatorship to the country.” Two members of the Atiku campaign team are already in detention for similar charges.

AC warns on dictatorship
The AC in a statement yesterday by its National Publicity Secretary, Alhaji Lai Mohammed said: “Our persistent warning that Nigeria is sliding into brutal dictatorship has, unfortunately, come to pass. Nigeria is in for a rough ride under the newest despot in town.”

Government, he said, had targeted the head of AC presidential candidate’s campaign organisation as a means of decapitating the ACO’s free-wheeling campaign, the success of which, it said, had astounded those with a morbid fear of an Atiku presidency.
It said the government’s plan was actually to arrest Vice President Atiku Abubakar, if he had lost the case to retain his office at the Court of Appeal on Tuesday.

There is absolutely no reason to feel disillusioned by what is happening in Naija, OBJ inherited a flawed Constitution from Abacha that could have been amended instead the presidency was contended to use these flaws to accumulate so much power and now one of those flaw is back to hunt him. As much as i want Atiku out, he has done the right thing by going to court.The judiciary should always be our last hope.

This is an old news. Atiku made this statement on the day he arrived back from UK.

A lot has happened since then such as INEC refusing to accept his running mate OBI as it does not make sense since he is already barred.

you are misleading, according to thisday reports, Obi was called to come back for screening at another time.

the punch also says, if the indictment is overturned then he will stand. both of the above statements came from INEC

The INEC Chairman, Prof. Maurice Iwu, had before the verification of the particulars of substituted candidates on Wednesday, said that the electoral body would ensure that those it put on the ballot papers were those who were constitutionally eligible to participate in the elections.

He also said that after the verification, INEC would proceed to print ballot papers with photographs of candidates embossed on them.

But our source said the commission had resolved not to put the names of all those indicted for corruption on the ballot papers.

According to him, the affected candidates will have their names omitted from the ballot papers, except their indictment is quashed by the court.

You still don't know what INDICTMENT means. How can a court squash an indictment?

OK, let me explain in a clear lay man simple English

Atiku is indicted (accused) and can only be prosecuted if he is no longer under immunity. Once he is prosecuted, the court will determine if he is guilty or not.

Since he prefers to stay under immunity, he cannot be prosecuted but the constitution barres him from contesting elections because he is indicted.

Is this hard for you Atiku's uneducated pimps to understand? Still confused?

the indictment was by an administrative panel of the FG, the validity and composition of that panel are being challenged. if it is found to be invalid by a competent court of law how can its indictment stand?

this is not a matter of prosecution, it is a matter of the validity of the so called indictment. stay off them cheap drugs and maybe you'll understand facts better wink

The Constitution that Atiku is using is the same Constitution that gives the FG the power to set up any panel to indict anyone such as Administrative Panel, EFCC, Tribunals etc.

To add to it: You do not contest indictment in court to contest elections, instead, you will be disqualified and prosecuted if you are not under immunity.

the actions of the FG can be challenged in court if

1. the panel was wrongly constituted

2. evidence used for its decision was lacking


no one said the panel can't be set up, its the constitution (or makeup if you are confused) of the panel, and its outcome that is being contested

i repeat, stay off the cheap drugs, its really affecting your reading

The court in every society has/is always politicized. that is why every U S president has always looked forward to the vacancy on the bench to appoint judges who share their political Philosophy after all they are human.

The fact is, the Senate has already discovered that OBJ is manipulating the EFCC and INEC to truncate the Presidential bid of Atiku, because OBJ has a lot to hide and if Atiku wins, OBJ would be probed.

People have forgotten that the wife of the governor of Bayelsa State governor was caught for money laundering, but OBJ and the PDP have distracted our attention from the case. But we have all the records.
Once Atiku becomes the President of Nigeria, Alams and Asari Dokubo will be released.
Then, the EFCC will be reconstituted and all those suspected of corruption will be charged to court.

No rule of law, no democracy.

Only the courts will determine the case of Atiku. And as we can see Atiku is not afraid of going to court.

No justice, no peace.
