James Ibori's counsel has filed a fresh suit to restrain the EFCC from arresting him over alleged fraud involving the shares of some companies.

Joined in the suit are the Attorney-General of the Federation, the EFCC, the Inspector General of Police and the Director, State Security Service (SSS).

In the suit, FHC/ASB/CS/34/2010 filed at the Federal High Court, Asaba, Ibori wants the court to stop the respondents from arresting him.

It was filed after Justice Ibrahim Buba adjourned proceedings in the substantive suit to May 10. Buba had on Wednesday refused to grant Ibori's oral application to restrain the EFCC from arresting him.

The suit is entitled "The Matter of an Application by Chief James Onanefe Ibori for the Enforcement of his Fundamental Rights to Fair Hearing and Personal Liberty under the Fundamental Rights Enforcement Procedure Rules 2009".

Ibori's counsel Mr Joseph Daudu, is specifically asking for an order of injunction restraining the 1st, 2nd, 3rd and 4th respondents from arresting his client.

He also wants the court to restrain the respondent's officers, agents, privies and assigns from arresting, harassing and intimidating Ibori in any manner pending the hearing and determination of the motion.

Daudu also asked the court to make any other orders that it might deem fit to make in the circumstances.
