A Federal High Court in Abuja has stopped further prosecution of former Attorney General of the Federation (AGF) and Minister for Justice, Mohammed Bello Adoke (SAN) over alleged fraud in the Malabu oil deal.

Justice Murtala Nyako yesterday ruled that Adoke’s involvement in the Malabu deal over the OPL 245 was in furtherance of lawful directives and approvals of former President Goodluck Jonathan in the exercise of his presidential powers as enshrined in the Constitution.

The Economic and Financial Crimes Commission (EFCC) on December 20, 2016 filed nine count charges against Adoke, former Petroleum Minister, Dan Etete, and businessman, Aliyu Abubakar over allegations of diversion of $1.1 billion proceeds of the deal from an escrow account to private companies.

The companies are: Malabu Oil and Gas Limited, Rocky Top Resources Limited, Imperial Union Limited, Novel Properties and Development Limited, Group Construction Limited and Mega Tech Engineering Limited.

But Adoke had approached the court in the enforcement of his fundamental rights against the Attorney General of the Federation (AGF), Abubakar Malami (SAN) through his counsel, Kanu Agabi (SAN) contending that he acted in furtherance of presidential powers contained in Section 5(1) of the 1999 Constitution.

LOBATAN. EFCC keeps allowing itself to be rubbed in the mud. Why can't they do a thorough investigation before approaching the court. All they are good st is media trials.

EFCC under Magu has done more damage to the anticorruption war. His activities are based on hearsays and advise from Marabout as against tenets of Law and thorough investigations. Even a foolish person know that you can not be convicted while acting under lawful directive

I wonder why GEJ is yet to be put on the spot,he is the answer to most of the high profile corruption cases.Nemesis will surely catch up with him one day.

Fight against corruption will never work in Nigeria until we are ready to prosecute ex Presidents.
What do you expect EFCC to do when the accused persons claimed that they were acting on presidential directives?
That's why Dasuki case couldn't progress.
Diezani claimed he acted on presidential directives.
Olisah Metu claimed he acted on GEJ's directive.
OBJ can't be probed, GEJ can't be probed and there ends the fight against corruption.

Good thinking.
Oil production would stop the moment GEJ is brought in for questioning or as a witness in court.
The government knows that he ordered most of the corrupt deals but it's not wise to go after him because his impoverished people would disrupt national progress. I hope one day, we will get there.
Nobody has questioned OBJ on electricity frauds during his tenure.
