Presidential aide, Lauretta Onochie has questioned, if Nigerian laws only applied to the poor following several calls on Federal Government to seek approval of Judges and lawmakers before prosecuting CJN, Onnoghen and Senator Dino Melaye.


Read her comments below,

Our laws cannot go after:
*lawmakers without the approval of the NASS.
*judges without the approval of the NJC
But our laws can just go after Teachers, traders, etc
This means the laws of our land only apply when it comes to ORDINARY NIGERIANS, the Common Man
Nigeria is in trouble.

Just like many others, Lauretta seem to be getting it wrong. Arraigning the CJN before the Code of Conduct Tribunal is like putting the cart before the horse.

This is from Jiti Ogunye and hope it clears all doubt ...

The path of the rule of law today is that the Federal Government of Nigeria or the politicians masquerading as anti corruption fighters who have issues with the CJN should have submitted a petition to the NJC on Onoghen’s alleged transgressions. If the NJC wants to sweep it under the carpet , they can file a civil action against the CJN and NJC seeking an order of mandamus to compel them to investigate the petition .

If the petition is to be taken , the CJN shall be asked to recuse himself from the meeting of the NJC that will constitute the NJC investigation panel, to guarantee fairness, impartiality and objectivity.

When the NJC decides, if the outcome is not favourable, the complainant can file an action for judicial review of the NJC Decision, asking the court to set it aside for lack of fair hearing, that the decision is ultra vires the NJC , that the decision is unreasonable, etc , etc .

This is what is called the rule of law .
