The law stated that if admit to his omission after notification, there is no need for such. Look, the judiciary is not under Buhari. The judiciary is not like the police or the military that is part of the executive. The presidency does not have the power to suspend and appoint a new CJN all by him self. He doen not..

It is like saying the president can sack the senate president. The judiciary and the legislature are independent arm of the govt. Buhari can not suspend CJN becus it is an independent body fully managed by the judicial commission. He can only remove after such recommendation by the council and national assembly.

These are the words of the CJN himself given absolute powers to the CCT when it comes to issues on false asset declaration below.

Do note that this is the same issue he is facing.

If I may repeat, the Code of Conduct Tribunal has been established with the exclusive jurisdiction to deal with all violations contravening any of the provisions of the Code as per paragraph 15(1). This provision has expressly ousted the powers of ordinary regular courts in respect of such violations.

The Tribunal to the exclusion of other courts is also empowered to impose any punishments as specified under sub-paragraphs (2) (a), (b) & (c) of paragraph 18 as provided in sub-paragraphs 3 and 4 of paragraph 18 while appeals shall lie as of right from such decisions to the Court of Appeal.

The real important question to ask at this stage is what is the consequences of the violation of the aforesaid paragraphs of the 5th Schedule to the 1999 Constitution?



“The answer to the above question is to be found in Paragraph 12 of the said Part 1 of the 5th Schedule which enacts as follows: -‘Any allegation that a public officer has committed a breach of provisions of this code shall be made to the Code of Conduct Bureau.’

“It is my considered view that the above provision is very clear and unambiguous. It provides a remedy in the event of any alleged breach of the provisions. The remedy lies with the Code of Conduct Bureau which has been clothed with the requisite jurisdiction to handle such matters.”

If you understood the above , you will see that the powers to act in an absolute form has been given to the CCT only when it comes to false asset declaration.

The CJN has admitted to false asset declaration. He is therefore guilty and must comply with the recommendations of the same CCT he empowered above

Which court order? The appeal court ordered a stay of preceding in the matter by CCT......by the way moving directly to CCT circumvents due process.....

The last time I checked Buhari was not an embodiment of our judicature so this brazen and brutush attempt at self help and atavistic tyranny is ultra vires, null and void.

I cannot recall a similar thing happen in this country. The coup and consequences did not start from a Chief Justice suspended, not removed despite being defended by 140 SAN. The suspended CJN was in office and all those certificate issues went through the courts. What was the verdict?

Talking of "little incidences", You call 140 SAN defending a CJ that has admitted default little? Itvis a big thing and what makes you think that they are not stakeholders of the " judicial exchange" or "stock exchange" where the CJ is the president. A forensic audit may trace tgese funds to the SANs and this explains their rush to defend him. It is even idiotic for SAN to join139 to defend a case where only two or three lawyers will address the judge.

Let us put things in clear perspectives.
