Osun State Governor, Adegboyega Oyetola has closed his defence before the state’s governorship election tribunal, sitting in Abuja.
Oyetola, who is the second respondent in the petition filed by the People’s Democratic Party (PDP) and its candidate in the last governorship election in Osun State, Senator Ademola Adeleke, closed his case on Tuesday, after calling 11 witnesses.
PDP and Adeleke are challenging the outcome of the election won by Oyetola, the candidate of the All Progressives Congress (APC).
Oyetola had, on February 1 this year, after calling his 11th witness – Adegboyega Rasaki Adeosunn, who acted as APC’s State Collation Officer during the election, promised to call four more on Monday.
At the resumption of proceedings on Monday, Oyetola”s lawyer, John Baiyeshea (SAN) told the tribunal that his client did not see any reason to call more witnesses and has decided to close his case.
Tribunal’s Chairman, Justice Ibrahim Sirajo adjourned to Wednesday for the third respondent, APC to open its defence. http://thenationonlineng.net/osun-gov-case-tribunal-witnesses/

Osun Election Petition Tribunal sat today with another shocking announcement from counsel to Gboyega Oyetola which confirms earlier reports of disarray within the respondents' legal team.

The court had commenced proceedings with the petitioner represented by N.O.Oke,SAN;Dr Paul Ananaba,SAN; and 38 other Counsels.

Curiously, the senior lawyers for the respondents such as Wole Olanipekun(SAN), Ajibola(SAN),Owonikoko and others were not in court but were represented by other counsels led Abiodun Saka Layonu SAN and others.

Then the bombshell from Oyetola's counsel: "my Lord ,after strategic review of where we are in this case and our current status, we have decided not to call any further witnesses, and hereby close our case"

Amidst outburst of laughter from the judges and petitioner's lawyer, the counsel proceeded : "We had considered moving a no case submission"

The sudden capitulation of Oyetola's defense team was linked to the mishaps the team had suffered in the hands of the few witnesses they summoned. Most witnesses so far called have ended up confirming petitoner's submissions:

* That there is massive alteration of election results by INEC;
*That the purportedly certified true copies of election results differ from the pink copies issued to party agents at the point Units which ought not to be so ;

* That the re-run was called without due process.
*That the rerun election was marred by violent, and rigged through massive disenfranchisement of PDP voters;

*That the rerun is invalid and illegal as it was based on illegal premises;

*That the State Returning Officer has no power to cancel the results of the seven units on the basis of which the rerun was ordered ;

*That on the basis of September 22 poll, Ademola Adeleke should be declared the rightful winner of the election.

No Case Submission

After Oyetola's lawyer had closed his case ,the APC Lawyer rose and promised to start the party's defence tommorow. He however also hinted that they may enter a no case submission.

Lawyers at the court however whispered to each other that no case submission would be novel in an election petition matters.

Others however hinted that APC may end up calling one or two witnesses starting from tommorow and thereafter close their case.

Our Case is God Supported- Albert Adeogun

The Deputy Governor designate, Hon Albert Adeogun told journalists at the court that the petitoner looks to God for justice in Osun state .

"Our progress and successes are from God. We are not alone.God is speaking and acting for us.It is about justice .Our God is a God of Justice ", he said.

He appealed to people of Osun state to continue to part for divine intervention,adding "we will all rejoice at the end of the day"

PDP in their days in power were stealing and robbing Nigeria with remorse, but APC are stealing and robbing Nigeria with boldness and confidence.
