I read the jumping up and down of APC members on the Thursday appeal court rulling,

It will be good if APC field candidate, however they are the architect of their problems.

Having said this, s look into what really happen in Abuja Appeal Today:

The appeal court sitting in abj yesterday 21st Feb 2019 dismissed the appeal filed by APC challenging the judgement of justice ljeoma Ojukwu that affirmed INEC stand, that the APC didn't conduct any primary election in zamfara state and that INEC was right to reject its candidates from Zamfara, the dismissal followed an application by APC to withdraw the appeal, the application was granted and the appeal dismissed
accordingly.

Next was the cross appeal filed by Yari & Co on jurisdiction and cause of action. The judgement given by the appeal court today
clearly stated that the appeal partially succeeded and went ahead to set aside the judgement of the lower court on jurisdiction only, but refuse to grant the cause of action component of the appeal (the court refuse to give inec order to receive candidates of the APC from Zamfara) the cross appeal
therefore partially failed because, from the onset APC had a complain against INEC only, Yari came to join the case voluntarily.

And the court in ojukwus judment held that "APC did not seek any relief against the 2nd to 6th dependants (Yari & Co) and considering that Yari and & Co didnt file a counter claim, or cross action against APC in the suit, she now held that Yari & Co have nothing to add in this case"

from the fore going the cross appeal by Yari and Co before the appeal court today, having failed partially is at best an academic exercise which doesn't add any utilitarian value to the case.


The assertion that appeal court has cleared way for APC to participate in Saturdays election is just a desperation manouevre by a desperate politician trying to get himself and his candidates to contest election by all means.

INEC should also remember that there is a subsisting appeal on the Zamfara High Court judgement in the sokoto division of the court of appeal in suit No;CA/S/32/2019.

The judgement of the Federal High Court according to the appeal court judgement still partially subsists since the appeal court refuse to give INEC order to receive Candidates, INEC is therefore bound to stand on
its earlier position that APC didn't conduct any primaries in Zamfara and they therefore have no candidates in Zamfara except the Presidential Candidate.


In summary:
1. In sokoto APC withdraw their appeal in sokoto and the court refuse to order INEC

2. In Abuja APC also withdraw its case leaving Yari &Co case alone, the court jurisdiction judgment was that the case was 15days after cause of action instead of the normal 14 days, the court however refuse to grant their second prayer I.e ordering INEC to accept APC candidate.

Hahaha..... What is INEC holding on to as at now to disqualify Zamfara APC Candidates......? Absolutely Nothing for Now... The Abuja court judgement they have been banking on has been quashed hence the only subsisting judgement as at today is the one of the Zamfara State high Court.

The issue in Zamfara case is very straight forward and if you don't know what the issues are, I will educate you.....


Here is a brief background to the Zamfara APC case..


Recall that INEC had declined to accept APC candidates in Zamfara because, according to the commission, the party failed to meet the deadline for holding primaries.

This gave rise to two different Court litigations. One at Zamfara State High Court while the second one was at FCT High Court Abuja.

On 25th of January 2019 precisely, the two courts issued conflicting rulings on whether the Independent National Electoral Commission (INEC) can accept candidates presented by the All Progressives Congress (APC) for Zamfara State elections in 2019.

In Zamfara State, a High Court sitting in Gusau, ruled that the governing APC actually conducted primaries in the state and should be allowed to present candidates for electoral contest.


An Abuja court, however, ruled otherwise.

The Zamfara court specifically directed INEC to accept candidates from the party for Zamfara States in the forthcoming elections.

Based on the above, I summarize as follows:

1. A High Court in Zamfara gave a judgement, ordering INEC to reverse its decision to ban APC from fielding its candidates.

2. A Federal High Court in Abuja same day gave a judgment ordering INEC not to accept the APC candidates.

3. INEC for reasons best known to it choose to obey the Abuja high court Judgement while ignoring the one given by the Zamfara state high Court.

4. However, the Appeal Court in Abuja yesterday set aside the judgement of the Federal high court Abuja which ruled that INEC acted within its powers by refusing to accept the list of candidates from the Zamfara State chapter of the APC.

5. In setting aside the Abuja judgement, the appeal court gave two major reasons......First they said the Abuja suit was filled out of time, the same reason that killed the chances of APC in Rivers. Secondly, they said the Abuja suit was an abuse of court process that it should not have been entertained in first place since a similar suit was already subsisting in Zamfara State high Court....

6. Thus from the forgoing, the only remaining judgement is the Zamfara State high court judgement that specifically asked INEC to allow APC Zamfara to field its candidate which up till today has not been appealed or Upturned. So, the APC Zamfara candidates are cleared now for the elections.

Finally the Sokoto Appeal court you mentioned has no bearing in this case because at the Sokoto appeal court the Zamfara high Court judgement was appealed however before the appeal Court would rule on it, the man who appealed the judgement withdrew the case hence the Sokoto appeal court struck out the appeal case still leaving the high Court judgement subsisting.

So INEC have no choice than to accept zamfara APC to contest.

Your analysis is deceptive and u know it.
When appeal rule a lower court has no juridiction, that completely invalidate the whole Judgment of that Lower court. It is as good as Abuja high court Judgment never happened. In essence it means Abuja high court has no right to hear the case in the first place.

Appeal court refuse to order INEC because it is unnecessary. What appeal court Judgement means is that INEC cannot put the Judgement in Abuja high court into consideration in making its decisions.

Rubbish ipob interpretation. The federal high court judgement had been set aside and is no longer valid. The Zamfara high court judgement was affirmed by the Sokoto appeal court and still remain the only valid court judgement as regards the Zamfara State APC primaries. INEC can no longer hide behind any finger again. APC will contest all elections in Zamfara and the people of the state will decide.

why are the pdp scared.they are disturbing us on how popular they are now but don't wanna face an opponent. Laughable .PDP better go and prepare to face a strong opponent in zamfara.

They are only popular on social media. Zamfara is an APC State with little or no PDP presence. PDP’s only chance of winning the State is by preventing APC from contesting. That’s why they are fighting desperately to stop the party from contesting.

Op,utilize your half common sense na.since the case at the sokoto appeal court has been withdrawn and the appeal court has struck out the ruling of the abuja federal high court,only the zamfara court ruling remains standing.

court has given theapc the go ahead to participate. Why are the pdp scared now.if they are man enough they should face apc like a man.that's the way to test popularity.
