This Year (2019) Elections Smart Card Reader As A Proof Of Evidence! I believe strongly as a Nigerian, I am a stakeholder in this Country! Therefore, I deserve to exercise my civic duties in consonant with the law of the land without any infringement whatsoever from anyone be it institution or individual. I must confess, if we are to score this government in the just concluded election, it will be right and just to say this is the "Worst Government To Conduct The Worst Elections In The Political History Of This Nation" going by the floppy arrangements of voting materials to designated places as recorded in some places across the nation, shoddy logistic supports, and the attendant complaints recorded by the electorates against INEC despite having a war chest of almost N200 billion to deliver a free and fair election to the Nation. The truth is, by the free gift of hindsight judging from what transpired across the Nation in the 2015 Presidential and Gubernatorial elections, shouldn't INEC have perfected the flawed areas in last election and give Nigerians worthy and credible elections we all can always make reference to as the best ever? Alas, it is on record now that this year *Election of 2019 is worst than 2015 election* and holds the record as the *Worst Ever* judging from political analysts and electoral scholars. It will surprise Nigerians that the *Best Election Ever In The History Of This Nation Remains The June 12 Presidential Election Of 1993*, guess what, it was not conducted under a democratic government but under the military junta we all abhor like an Anathema, the General Ibrahim Badamasi Babangida military rule! Before I proceed with my postulation, let me submit the following facts about the Smart Card Reader used for this year (2019) elections for your perusal and guide for optimum education; *Once configured, the Smart Card Reader can read your fingerprints and Permanent Voter Cards (PVCs) issued by the Independent National Electoral Commission (INEC). Therefore, any person that shows up at the polling unit without a PVC or with a card not issued by INEC will not be able to vote. It can also collate results under its "E-collation" interphase and stored the captured figures in INEC's back end server!* *The Smart Card Reader reads the embedded chip on the PVC, not the barcode, and it shares a secret code with the PVC; thus it is impossible to falsify the cards. (In the case of cloned PVCs being captured by Smart Card Reader as being reported in some quarters, definitely these are not Smart Card Readers deployed by INEC)* *The Smart Card Reader authenticates the identity of the voter by cross-matching his/her fingerprints with that stored on the embedded chip and in a situation where your fingerprints are not captured a Voter's Register form (replacing the incidence form) must be filled which already have your photograph, name and Voter's number and you only need to thumbprint on a space provided and write out your phone number for authentication. No person can vote using another person’s PVC.* *The Smart Card Reader keeps a tally of all cards read, comprising the details of all voters verified as well as those not verified, including results collated at the polling units and transmits the collected information to a central INEC server via GSM data service.* *The Smart Card Reader ensures that information transmitted to the server will enable INEC to audit results from polling units, as well as do a range of statistical analysis of the demographics of voting.* *Collation officers will also be able to use information transmitted by the Smart Card Reader to audit polling unit result sheets and determine whether accreditation figures have been altered.* Like I indicated above, this year Smart Card Readers (the hand held device that looked like a POS machine) have an interphase on them that indicates "E-collation" once you are in this phase you send the total accredited number of voters and also the transmissions of results to INEC's server directly. The National Commissioner of INEC, Okoye said, "The commission has taken onboard the challenges and glitches faced in the use and deployment of smart card readers in 2015 and has made significant improvements and upgrade to the said smart card readers. The upgraded smart card reader is faster, more robust and has new features that enable it to store additional data and transmit results," he said. (You can read about it here; https://www.legit.ng/1208776-smart-card-reader-conduct-2019-elections-inec-assurance.html) One thing worthy of note is that, in this concluded elections, the Smart Card Reader will ensure effective accuracy of data entered into it and should the manual collated written results are tampered with, this can easily be corrected through the information obtained from the Smart Card Reader. So, in this case, Atiku is relying on this electronic transmission of results from polling units and collation centres across the nation as his strong points against the outcome of the Presidential Results. It must be noted that the importance of the Smart Card Reader was established firmly as an integral part of this year's election by INEC and this same INEC even threatened to cancel elections conducted in any polling units that fails to use the smart card reader. Judging from reports from INEC's field officers in the Presidential elections, it was confirmed that in Niger State, about 10 local governments out of the 25 local governments in the State did not make use of the smart card reader at all because presiding officers were forced to resort to manual voting on the excuse that the smart card reader failed to function which are not tenable. The truth is, there is no link whatsoever between the networks of telecommunications service providers and smart card readers. Smart Card Readers operate independently via GSM data service. Nevertheless, INEC had already established it that the non use of the smart card readers contravenes the Electoral Act, insisting that the smart card readers were integral part of the electoral process and therefore mandatory for it to be used during the election. Atiku had presented his *plethora of evidences* before the world so it is no longer a thing of the Court of Law alone but now before the Court of Public Opinion which involves the Social Media involvement. As a man of conscience that I am and swore to be till I breathe my last, I can declare it boldly that judging by the impacts of the social media in this age, and its strong influences in shaping our characters either as institutions or individuals, *no court of law will jettison the Smart Card Reader captured results data on this election for hand written collation of results which can easily be altered!* *As the case between Atiku VS Buhari/INEC/APC is already set in motion, the whole world now become the spectators in the amphitheatre's match of the gladiators. You people should stop peddling lies, INEC Smart card reader can only transmit total numbers of accredited voters. Those of you giving Atiku hope through his purported INEC server should ask this question. Can card reader determine who voted which party? If truly it was used for e-collation, are all the parties total votes scored entered into it? Lastly, the electoral bill declined by Buhari allowed for e-transmission of results from polling unit to INEC server, but since the bill was declined. Elections were conducted manually, results inputed electronically at the collation centres. Therefore, Atiku server claim is dead on arrival. 7 Likes |

Stop repeating this lie, there is nothing like e-collation! The SCR only stores and transmits total number of accredited voters both successfully and unsuccessfully verified. If the total votes cast exceeds those numbers the election from the PU is canceled for over-voting which (the PU cancellation) happened all over the country. 1 Like |

garfield1:In 2015 or 2019? I don't get you. In 2015, "it was not declared as in integral part of election" because it was test run by INEC that's why manual voting abound in many places. In 2019, INEC declared it to be "an integral part of election and therefore fulfil the provision of electoral act" as stated in the post up there. Ratello: The Electoral act was amended in 2015 and it legitimized the use of card readers, it was signed by Jonathan The NASS amended the act again in 2017 and 2018 to include e-collation which the card reader has capability to, but Buhari declined assent. Again, the electoral act section 52 empowes INEC to set electoral guidelines and this guidelines have the full weight of the law and in the guideline for the last election, INEC clearly stated that any result from a PU without a card reader is invalid. garfield1:Sorry, the electoral act of 2015 was signed by Jonathan and it legalized the use of card readers. Go and check section 52 of the Electoral Act (Amended) 2015 and again, the Supreme Court decision that set the card reader precedence was made in a split decison 5-2. Again, INEC guideline in 2015 about the use of card reader is quite different from the 2019 guideline. How Electoral Act 2015 Legalised Card Reader – Punch Newspapers Femi Falana In December last year, the Supreme Court upheld all the disputed governorship elections conducted by the Independent National Electoral Commission on April 11, 2015 and undertook to adduce reasons for each of the judgments at a later date. Last month, the court announced the reasons for the decisions. Essentially, the apex court vehemently disagreed with the judgments of the Court of Appeal which had set aside election results which emanated from manual accreditation instead of the card reader machines prescribed by the INEC. For not validating the use of card reader for voter accreditation some commentators, including lawyers, have criticised the verdicts of the apex court. The criticisms which have greeted the judgments are not unexpected given the controversy which trailed the use of card reader for the elections. Although the National Assembly had approved fund for the purchase of the card reader machines in the Appropriation Act of 2014, the then ruling party wanted to use its control of the federal legislature to discredit the electronic device. Hence, the immediate-past chairman of the INEC, Prof. Attahiru Jega, was summoned to the Senate to justify the introduction of the card reader for voter accreditation. In taking up the challenge, Prof. Jega demonstrated the use of card readers and its capacity to eliminate electoral fraud perpetrated at the accreditation stage of election. At the end of the exercise the Senate was compelled to endorse the use of card reader for the 2015 general election. Thereafter, the Electoral (Amendment) Bill 2015 which sought to legitimise the use of card reader was unanimously passed by both chambers of the National Assembly. The bill was signed into law by former President Goodluck Jonathan on March 20, 2015. Prior to the amendment, Section 52 of the Electoral Act had prohibited the INEC from the use of any form of electronic voting. But following the amendment of the provision, the INEC has been conferred with the power to determine the procedure to use for any election. Specifically, Section 52 states that “voting at an election shall be in accordance with the procedure determined by the Independent National Electoral Commission.” With the amendment of the law the INEC was on terra firma when it decided to use the card reader machine for the accreditation of voters for the 2015 general election. In spite of the initial hiccups encountered by voters with respect to the use of the card reader machines it is generally agreed that the technological device enhanced the credibility of the 2015 general election. Indeed, a number of the election petitions filed by aggrieved candidates were anchored on the gap between the number of voters accredited with the card reader machines and the fake election results declared by some returning officers. At the election petition tribunals, the INEC, through its lawyers, canvassed rather curiously that the directive on accreditation of voters with the aid of card reader machines was not backed by any law. And that the failure to comply with the directive could not vitiate any election conducted by the INEC. Some members of the Election Petition Tribunals and the Justices of the Court of Appeal upheld the submissions of the INEC lawyers. In their judgments they ignored the figures of accredited voters obtained via the card reader machines. Others were however convinced that the directive on the use of card reader was backed by the letter and spirit of the Electoral Act. In the case of APC v Kolawole Agbaje, Ogbuinya JCA traced the genesis of the card reader when he said, “The evolution of the concept of smart card readers is a familiar one. It came to being during the last general election held in March and April, 2015 in Nigeria. On this score, it is a nascent procedure injected into our infant and fledgling electoral system to ensure credible and transparent election. Specifically, it is aimed to concretise our fragile process of accreditation – the keystone of any suffrage. The concept, owing to its recent invention by INEC, a non-legislative body, traces its paternity to the manual for election officials, 2015.” The above view of Ogbuinya J.C.A was adopted in toto by Ejembi Eko JCA in the case of Umana v Emmanuel, when he stated that, “I do not believe that with the fast pace of development globally and the whole world embracing the latest IT technologies, that resistance should be placed to emerging technologies geared towards transparency in elections, by backward thinking interpretations that can only be deleterious to the system. Holding otherwise would be to truncate the great efforts of the 3rd respondent (INEC) in its bid to ensure a credible election and in so doing attempt to plug all loopholes that can be exploited by unscrupulous persons.” Regrettably, the Supreme Court did not share the progressive view of both Ogbuinya and Eko JJCA on the legal validity of the technological device. Thus, in the case of Edward Okereke v Dave Umahi the apex court held that the appellant failed woefully to prove the allegation of over-voting as he did not tender the voters’ registers along with the card reader reports. Justice Cletus Nweze, who read the lead judgment of the court, held that, “Indeed, since the Guidelines and Manual, which authorised the use and deployment of the electronic card reader machine, were made in exercise of the powers conferred by the Electoral Act, the said card reader cannot, logically, depose or dethrone the Voters’ Register whose judicial roots are firmly embedded or entrenched in the selfsame Electoral Act from which it (the Voters’ Register) directly, derives its sustenance and currency….since the National Assembly has not deleted the provision of Section 49 of the Electoral Act (2010), which allows manual accreditation, it would be wrong for any petitioner to seek to rely solely on the report of the card reader (which is intended as a supplementary measure to the already provided means of accreditation) to prove over-voting.” However, in spite of the clear position of the INEC on the mandatory use of card readers for the governorship and state legislative elections it did not adduce any argument in favour of the use of electronic device at the various election petition tribunals and the appellate courts. It is particularly intriguing that the INEC did not defend the card reader by relying on Section 52 of the Electoral Act (Amendment Act) 2015. If the attention of the Justices of the Supreme Court had been drawn to the 2015 amendment of the Electoral Act they could not have held that accreditation by the card reader machine was supplementary to manual accreditation. In other words, the judgments of the apex court would have legitimised the use of card reader for voter accreditation. No doubt, the legitimisation of the card reader would have had dire consequences on the results of the disputed governorship elections. This is exactly the same thing one guy was arguing about claiming he was also a staff of inec in the just concluded election, not until another guy came and explain everything and even showed him screen shots of party list on the card reader. He said some of the staff didn't know how to transmit the result with the card reader, the RACTEC guys were the ones doing it for them.
