Hello All, i and my family got refused today. My husband is our sponsor. We planned to spend 3500 on this trip. 1500 for me, 1500 for him and 500 for our child. I am employed and my husband is as well. He has properties that he inherited from his grandmother which gives him income which came in starting in August this year due to the pandemic. We attched property documents and rent receipts,rental agreements to prove the source of funds. The ECO kept mentioning my bank account balance when i am not the sponsor. What is the next best step for us?

simba01:Sir pls I said you have to confirm with your employer the english language requiremnt they want from you. Some professions eg medicine no longer have to present english language documents for visa application. Pls confirm from the ppl first U can’t have a tier 2 visa without employment offer pls. |

Fali85: I note that just few days ago you showed us a refusal letter with this same pattern that ECO complained of.... large deposits.. u also stated then that it was esusu/ajo. It was also deposited few months to ur visa app. With this and the above, I genuinely think you guys dont have the funds available and are trying several avenues to over magnify your situation to look as though you do. Look at the above letter, in the space of how many months just before visa app, multiple large deposits in millions hit ur acct... i think u sincerely know what happend.. pls work on ur financial situation as well as ur ties and wait until ur circumstances change. Gone are the days when money lodgement used to work, right now it has casted.. so very much so. |

giselle237: Thank you for your response. The previous esusu/ ajo post was on behalf of my sister. As for the lodgements the opening balance of the account which was in june was about 7million. My husband paid for investments which brought the balance to nil just before the rents started coming in. We intend to wait till January or march before trying again. 1 Like |

Fali85: I understand that your husband is the sponsor but your income is low compared to the amount you intend to spend. Unless you or your husband is earning substantial income that 1500 pounds will be within his 1 month salary, ECO will frown at your budget. Inflows in August were seen as one off. You have a huge balance in your account but ECO was not convinced that the inflows were not meant to shore up your account balance. I'd suggest you restrategize and reapply but you must convinced ECO about the inflows in August. I'd suggest you reduce your budget or the length of stay. |

Fali85:Ok then pls let me know If you or your husband is working . If so is it paid employment or self employment? The 14 million naira account balance was made up by all your large deposits in the space of 3 months. This is a problem. |

Fali85:Hmm the proof of funds were all sudden deposits in millions from rent according to ECO. It all looked like a planned work to them to justify the large deposits. All of these funds came suddenly also. Before these deposits the acct balance was 90naira. However if you have/had proper documentation to prove to the visa officer tht there are indeed properties that belong to your husband that u rent out and have always had these property, i do not think u would have been denied. |

Fali85:It’s not wrong to have funds. Funds must have paper and proper evidence to show their origin. For UK visa this is always a great hurdle that must be passed. |

giselle237: What other documents are there to prove properties? We attached property deeds, inheritance documents and addresses. We attached rental receipts and 2 rental agreements. How else can you prove you receive rents? Aside these? Do they mean agreements supersedes receipts? |

TheExalted: Thank you for responding. I stated clearly that he will be solely responsible for my expenses. I only attached my proof of income as ties. My husband clearly stated that he will be solely responsible for all our expenses. Do they mean that for instance unemployed wives are no eligible because they do not have funds in their account? Maybe i should not have included my bank statement. |

Fali85:The problem is that all of the money in ur account, all of it came suddenly and is also from supposed property. Dou have any other ties to Nigeria eg employment? If none of you is employed there is also a big problm. It will further solidify their claims that this is all money lodgement. I saw ur salary yes, what of ur husband? Is he employed By the way ur income is low to serve as a tie to nigeria |

giselle237: My husband's salary is 85k after all deductions. Monthly expense is 70k. My salary is 108k, Monthly expense is 50k. But i will like to point to you that they did not mention disposable income on both parts. That is because he declared another source of income which is where the rent comes in. And its from the rent we receive as income we intend to pay for the trip. |

Fali85:The problem is not the rent. Nor the documents i am sure of that. the lodgement is the problem. It seemed strange and plus your combined incomes are so low, it only make sense that to them u both were trying to cook up stories. If u can provide a back history of such rent payments coming in with appropriate narration say in the last 1 or 2 years till now it might help. As eco maybe able to see that truly this form of income had existed since and not sudden cus u want to obtain a visa. If also u dnt have a travel history to other countries, it also further weakens ur profile. It looks like u both just want to obtain visa and then run out. The onus is on u to prove beyond all reasonable doubt, that u are not potential overstayers. U dnt have well paying jobs that might even keep u here, na to reach there and overstay and possible get someone to be sending ur rent money to u afterall the salary u are paid in Nigeria is negligible. This is ECo’s thinking. Pls think like them. We are Nigerians with a long history of overstaying visa. Thats why we re treated this way. Pls kindly look for how to convince them tht u are not an aspiring couple seekin to crossover to uk, therein lies your successful app. |

Fali85: The salary is just too low for the budget. The large inflows will not be considered. Wait for sometimes. If you can show huge account balance 6 months from now, perhaps ECO will be convinced that your husband indeed inherited property that gives him large income aside his day job. With this new information, please don't just reapply immediately. The issue is not your husband sponsoring you. The issue is that you don't have enough earnings aside the large inflows which ECO disregarded. |

Sorry, I actually meant my payslips bear my maiden name, but I didn't state in the application form, that I'm also known by another name. This "Your given name is usually your first name. Your family name is the surname that is shared by your family. If you have middle names, include these with your given name. If your name has a suffix (e.g. Jr), include this with your given name. If you have a patronymic name include it with your given names. You must tell us all your given names." This should not be an issue. Guess you used your maiden name?
