2023: Cracks In Jonathan's Camp / Buhari, Not Jonathan To Be Blamed For $9bn Judgement Debt, Says P&ID / N1.3trn Looted Funds: Jonathan's Camp Lists Corruption Cases Under Buhari (2) (3) (4)

Jonathan Camp Speaks On $9bn Judgment Against Nigeria On Friday 17th Aug, Makes by octus2008(m): 12:43pm On Aug 21, 2019
The camp of former president, Goodluck Jonathan has accused Buhari administration of trying to make a case against former President Goodluck Jonathan by claiming that he is responsible for the $9 billion judgment against Nigeria in the United Kingdom in a case brought against the nation by Messrs P & ID.

Former presidential aide, Reno Omokri, in a statement on Saturday, said the attempt to rewrite history will backfire.

Omokri said part of the filings regarding the case read: “P&ID submits that it entered a gas supply and processing agreement with Nigeria’s Ministry of Petroleum Resources in January 2010. Pursuant to the agreement, P&ID claims that it would build the necessary facilities and then refine natural gas into non associated natural gas for a period of 20 years.”

According to him: “Now, Nigerians should stop there and ponder. This transaction occurred in January of 2010. Former President Jonathan was not President in January 2010. During that time, he was completely shut out of power by an unelected cabal that ran Nigeria during the period of the ill health of the late President Yar’adua, before the National Assembly courageously intervened on February 9, 2010.

“That cabal not only fought against the ascension of then Vice President Jonathan to the office of acting President, but went beyond that to take documents, including budgets and contracts, to Saudi Arabia, and claimed that the then ailing President Umaru Musa Yar’adua had signed them.

“Nigerians may recall that the cabal announced on December 28, 2009 that the ailing President Yar’adua had signed a supplementary budget and other documents from his sick bed in Saudi Arabia, without the foreknowledge or acquiescence of then Vice President Jonathan or the Executive Council of the Federation.

“In fact, a week later, the Conference of Nigerian Political Parties (CNPP) came out with an exposé alleging that the signatures on the documents were forged and Femi Falana (SAN) took up the case in court.

“The man who packaged and arranged the signing of the contract with P & ID was a member of the cabal and Yar’adua’s minister for petroleum, the late Rilwanu Lukman.

“Mr. Lukman and other members of the cabal treated then Vice President Jonathan with disdain and kept him in the dark about their actions because he had no executive authority, as the then President was unable to hand over to him as constitutionally stipulated due to the suddenness of his ill health.

“That same cabal has resurrected and has now coalesced around President Muhammadu Buhari, with some of them being made either ministers, or formal and informal advisers. As a matter of fact, the main man behind that cabal is now one of the closest persons to General Buhari.

“Nigerians may want to note that while this controversial contract was signed in January of 2010, former President Jonathan only became acting President on February 9, 2010.

“So, if the Buhari administration is looking for someone to blame for this judgment against Nigeria, it should look at its own cabal.”
Let me summarize, for those too lazy do small research.

After Yaradua's death, the cabal took over government for close to 6months, completely shutting GEJ out of government. Within this time, Late Rilwane Lukman who was the petroleum minister at the time quickly packaged a fraudulent deal with P & ID and signed Nigeria's future away.

When GEJ finally took over, the deal was reviewed and found to be bad market for Nigeria, so he insisted that the deal be renegotiated. P&ID refused, knowing fully well what they got from Rilwane and instead took Nigeria to arbitration. In 2013, they won the arbitration and were awarded about $6billion, being the money they would have earned if the deal had gone ahead, whereas, Nigeria would have earned next to nothing.

GEJ, the diplomatic man that he is sent Diezani, Okonjo Iweala and some other guys to Ireland to negotiate an out of court settlement with P&ID. Finally, early 2015, P&ID agreed to take $850million instead of $6billion.

But GEJ then handed over to Buhari who first wasted 6months before facing governance. Then he made himself petroleum minister and without even understanding the details of the deal and subsequent arbitration and out of court settlement, and in a bid to vilify his predecessor, Buhari refused to pay the $850million and went back to court. Ultimately, he lost the case, as expected and because it's been 6years since the original arbitration, the money plus interest accrued is now $8.9billion.

P&ID are no longer interested in the out of court settlement and have now been given authority to take over all of Nigeria's assets in the UK to the tune of $8.9billion. if they don't get up to that amount in the UK, they will also take their case to the EU and US until every penny is paid. Worse, every day that passes, the money continues to yield interest.

In conclusion, a criminal cabal created this mess for us, GEJ did his best to minimize the effect of the mess, but Buhari, in a bid to spite GEJ spoiled everything. Now here we are....

Do you expect Jonathan camp to speak against their master? Sincerely ask yourself. In 2013 , when the court awarded fine against Nigeria for breach of contract. Why did Jonathan fail again to pay the compensation in 2013/ 2014 and 2015. And further sincerely ask yourself. Why did Yaadua / Jonathan government entered into contractual agreement in 2010 when they knew they will never honour the agreement?
It was written by Omokiri himself the contract was signed in January 2010. While Jonathan became the president in May. While did he not review the contract until 2013 when a fine was imposed on Nigeria? ABI Yaadua was still the president in May 2010 down to 2013? Think before you post

Even if GEJ did not live up to expectation but he setup a negotiation team since the money demanded by the company was too much. By the way it is written in piece that the cabal who are now Buhari's right that were instrumental to signing such useless contract while keeping a sitting vice- president in the dark.
By the way why didn't Buhari paid the negotiated 850million dollars and stop going back to court?

Mr. Man A contract isn't easily revoked. The person who signed it is dead. Goodluck decided not to pay the $850 Million to avoid suspicion. Oya answer why Buhari decided to fight a legal battle he knew he wasnt going to win?? And answer why didn't he stick to out of court settlement?

Reno is not intelligent as I thought, Jonathan government cannot shift the blame to anybody not yaradua, cabal or buhari. Reasons
1. His government found out the contract was not going to benefit Nigeria , so that cancelled the contract even when the know the implications.
2.For 5years the could not settle disputes resulting from their action, even when lost the court case.
3.What stopped him from paying the agreed out of court settlement before leaving.
4. You don't expect an incoming government to go ahead to pay such amount of money to a company that did absolutely nothing to the country without challenging it.
Reno stop twisting facts to favor you always, sometimes it better to keep quiet and say nothing.

Slowly read through this again:

1. If you read clearly, you'd have seen that it was reviewed when he came into office, found out to be a bad deal and proposed a re-negotiation. The company refused and took Nigeria to arbitration for breach of contractual terms.

2. Nigeria was slammed with a fine of $6billion. GEJ, rather than waste our resources, sent a crack team to re-negotiate that amount as it as not yet a final award. They succeeded in getting $6billion down to $850 million as full and final payment. Why would you want him to pay $6 billion when he knew there was room to get a less sum which he successfully did.

3. Negotiation was concluded in early 2015, in the heat of coming elections. Now be honest, if he had authorised the release of that money, would you and other APC goons like yourself not have screamed and labelled him the king of the highest form of corruption? Would Lai Mohammed and co. not have capitalised on it to claim that he was stealing public funds for election?

4. He hands over to your lord and master Buhari, the 'winner' of the 2015 election. If you were Buhari what would you have done? Is it not to review and pay? If you decided not to pay but rather go back to arbitration, would you not have ensured a diligent team was on ground to argue favourable terms for the country you claim to want to save from economic loss?

5. If you had read the reports clearly, you would have seen that not only did Buhari and co refuse to pay $850 million agreed upon, they were not even diligent in the arbitral proceedings! in other words, there was absenteeism on the part of the Nigerian team so the sum was entered finally as default judgment against Nigeria plus interest rates!

Whose fault is it now really? You people should stop acting as if Buhari is perfect and knows all things or he is without blemish and incorruptible. His incompetence has caused Nigeria this humongous loss and the interest rate is mounting for every other day of default!

Excerpts from an analysis:

P&ID agreed to accept $850 million in compensation, negotiated down from an initial proposal of $1.5 billion by a government committee. The payment was to be made in four tranches — $100 million at first and then in three instalments of $250 million each. These were in the last days of President Jonathan, who had lost his re-election bid. He still wanted the figure reviewed downwards, but decided to leave matters for in-coming President Muhammadu Buhari. However, the Buhari administration, without a cabinet in place, did not follow up. P&ID then got the award in July 2015 — $6.6 billion for “loss of income” over the lifespan of the GSPA and $2.3 billion in interests.

In fairness to Buhari, when he came in, Nigeria’s economy was already on its knees. Oil prices were down, there was forex crunch and states were owing salaries. The last thing on his mind was an $850 million payment for a project that never was. It seemed somebody whispered to Buhari to ignore the settlement agreement because of the “PDP factor”. That was a very wrong approach, I would say. If Buhari did not like the figure, he could have further negotiated it down. Nigeria is a sovereign entity and agreements are binding on all administrations. The P&ID guys complained that they waited in vain for Nigeria’s phone call, so they continued with the arbitration and got the huge award.

I will reply because you appeared intelligent but I will ignore where you gave me Apc membership card. Now back to the matter, Jonathan government lost the case in 2013, they didn't go on an appeal which means they have accepted the judgement OK. Out of negotiations started and ended in 2015 according to you and Reno, the government did not stop to function because of election so what stopped him from honouring an agreement he entered into, the excuse of what opposition will say is why his was a weak president because you cannot expect opposition to approve your actions even when you mean well. For buhari what he did is what any leader will do because before accepting to such huge amount of money to a company for doing nothing, you must make sure that you have exhausted all legal options available to you,
It is the right to do my brother, what that company provide did was pure robbery nothing more.

You need to understand how arbitration works. The award in 2013 was not final so the question of an appeal does not arise. There was room for negotiations which the then government took and arrived at $850 million in 2015, far less than $6 billion. The right of appeal has now arisen because the final judgment sum of $9 billion has been entered against Nigeria. You must also be careful and aware of your circumstances or political environment at all times before taking actions before one falls into avoidable accusations.

With the way this APC government operates, you can be sure that if Jonathan had made that payment any time in 2015 whether before or after the elections, it would have still been used as a talking point for 'inherited 16 years of PDP' till today. They would have claimed that the government could have gotten it quashed completely at the tribunal but GEJ hurriedly paid just to share or split money with whomever. If not because of these painstaking discussions, a lot of people would have assumed that since that agreement was signed in 2010, it must have been by GEJ's authority, conveniently forgetting that it was signed in January 2010 when Yar'adua was still in office.

The Nigerian government is one and ad continuum. Buhari did not get Ministers and advisers until 6 months after he came into office; he did not keep channels of negotiations open with those holding the yam and knife on this issue. As he decided or was advised to continue arbitration, he ought to have ensured that the Nigerian team was up to the task. Well, since you say Buhari's actions are correct, you see the outcome now..

Please tell me, $850 Million and $9 billion, which one is a 'better' or cheaper debt to pay? He could have even negotiated payments in installments but just to hang everything on PDP/GEJ, see the status today!

You keep saying what would've happened, as reason for not honoring an agreement they entered into. Which sounds lame to me. For the present government they have what is expected of them which is appealing that judgement. Every litigation had two possible outcomes (favourable or unfavourable ) , I don't believe they will get that amount of anywhere, so at the tail end an agreement can be reach by both parties. Anyways it was nice engaging you. Note I don't do party so don't be surprise to see bashing this government in another topic. Peace .

The government entered into that agreement regardless of who was president. One president signed the contract, another decided that the contract was seen to be unfavourable for Nigeria and resolved to the point of a negotiated settlement. If the same president continued in 2015, he would have paid it off. Now he handed over to another president and rather than make things better, he has compounded issues! Did Nigeria stop in 2015? Please the president is responsible for the country. It happens to be Buhari now, he should own the responsibility and deal with it! No blame game or shift!

Ok GEJ cancelled the contract initiated by Yaradua government in which he was vice because it does not benefit the nation instead continuing with contract since government is continua, rather he breach a legally binding contract and decided pay out $850m and the next government acting on national interest said no we can just pay out $850m to a company for doing nothing rather will challenge it towing the line of GEJ who did not honor an agreement entered by Yaradua. Just following your logic my sister.

Buhari thought that this is Nigerian judiciary system where he can control proceeds by proxy.
They international court has shown him what justice and interpretation of law is. Well it's the common man that will feel the heat of this!
Why do Buhari keeps reappointment himself as petroleum minister when it's obvious that all that he knows is military administration. Are there no competent Nigerians that can do the job?
Or is everyone corrupt except him?
$9b is a whole lot of money!!!!!!
