$9.6b P&ID Award: How the Supreme Court of Nigeria under the leadership of Justice Ibrahim Tanko Mohammed and President Muhammadu Buhari threw away $40 billion

Many are out for the head of ex- Chief Justice of Nigeria Alfa Belgore for helping the British Firm, Process and Industrial Developments Limited to secure the arbitral award of $9.6 billion against his country but few don't know that under the leadership of the present Chief Justice of Nigeria Justice Ibrahim Tanko Mohammed, Nigeria lost over $40 billion that could have boosted our foreign reserve when Supreme Court Judges dismissed a $40 billion patent royalty case against oil multinationals Exxon Mobil.

On the 5th of August 1999, Comandclem Nigeria Limited got a Patent certificate for the invention of an Anti corrosive Paint for Mobil Producing Nigeria Unlimited. This Patent was issued under the government of Chief Olusegun Obasanjo. The anti corrosive paint has been in use by Mobil Producing Nigeria Limited since the 1980's till date in maintaining their facilities.

Having applied for the patent and the patent certificate No.RP.13522 was issued, Comandclem Nigeria Limited became the registered Patentee in the invention called Anti-Corrosive Special Paint. This same invention had accumulated over $40 billion in expected royalty with a potential of more $ 150 billion that could do wonders for the Nigerian Economy by boosting our foreign reserve.

Exxon Mobil refused to pay royalties due to the Nigerian Company Comandclem Nigeria Limited and a legal battle ensued that lasted for almost 2 decades.

In year 2011 after recording remarkable success at the Court of Appeal, The CEO of CINL called on Exxon Mobil for resolution of the matter. Chief Olusegun Obasanjo was called upon to mediate and through a letter, he summoned Exxon Mobil to a round table talk. Exxon Mobil refused to honour the invitation.

Exxon Mobil refused to come to a round table and Chief Olusegun Obasanjo advised Comandclem Nigeria Limited to seek redress in court. After several days in court when the matter between Exxon Mobil and CINL came up for hearing, the Supreme Court Justices brought out an alien withdrawal letter purportedly filed by an ex-staff of the company whom the company had publicly dismissed with newspaper publications to that effect. With all evidence including pieces of the newspaper publication and dismissal letter of the said staff before the Supreme Court showing that nobody authorized him to withdraw at any given time, the Supreme Court refused to go ahead and eventually dismissed the appeal. All efforts to restore the case proved abortive till date as rumours stirs around that Exxon Mobil in conjunction with the said dismissed staff having taken bribes forced the Supreme Court to do Injustice.

The submission of the said staff was that Exxon Mobil promised to negotiate with Comandclem Nigeria Limited provided they withdrew the appeal at the Supreme Court of Nigeria. A submission which he claimed prompted him to withdraw the case. However, the Supreme Court failed to diligently see through the fraud being perpetrated by Exxon Mobil in conjunction with the dismissed staff and ended up making CCNL suffer double jeopardy by dismissing the restoration motions and closing the door to $40 billion without considering the monumental loss to Nigeria and Nigerians who are direct beneficiaries of this windfall.

That being said, The dismissed staff (former) acted without instructions from the management of the company either in filling appeals at the supreme court or withdrawal of appeal while Exxon Mobil for the second time in the history of the case benefitted from their own fraud. The Supreme Court was not diligent enough to see through it to decide if this little issue was enough to rob Nigeria of $40 billion.

We have not been vigilant to consider seriously the plight of the country in our quest for personal survival and wealth. We must learn from the patriotic stance of the UK Judiciary and while we try to escape the imminent loss of $9.6 billion to PID, we must remember that our foreign reserve could be $40 billion higher in no time. All it takes is for the courts of the land especially the Supreme Court of Nigeria is to learn from the P&ID case and wear patriotic robes when next they entertain Suit SC/69/2011 at the Supreme Court of Nigeria.

If we lose $9 billion to P&ID, we can gain $40 billion or probably force the UK and US courts to think twice with a weapon as potent as the Anti corrosive special paint which has accumulated over $40 billion in expected royalties.

Its a similar case and the oil multinationals breached a contract too. So Nigeria can use the matter do strengthen their negotiating position by restoring the appeal against the American owned company.

We will now see if the court will grant P&ID victory in case pending in Washington over payment of $9.6b. They take 9.6billion and we will take $40billion. Simple.

As seen in the second image, Exxon Mobil told Chief Olusegun Obasanjo that they won't negotiate with case pending at the Supreme Court, so if the case was withdrawn so as to enable them come to a round table, why won't the Supreme Court restore the case for continuation when negotiations failed?

Also, when the company presented evidence to show that, they did not ask any staff let alone an already dismissed staff to withdraw any case at the supreme court, why would the court insist on not restoring the case if not that something else is involved?

This is our ace. Our leverage against P&ID and also the impressively patriotic UK and US.

Will the federal government see any sense in this in the face of $9.6 billion fine? Only time will tell.

I guess if this reaches front page, it will get the needed exposure
