I had the same issue with my Landlandy and if not that the guy stated his own as Landlord, I would say he is the second guy that we live together. I and a co tenant were severe d notice to quit in October and September respectively. The six mnth notice is absolutely free. You only need to pay for other bills aside the rent. 1 Like 2 Shares |

Let him know that you're not interested in staying in the house any longer....pretend to have made provision for relocation even if you haven't. Pay him by march. |

Please note, that the six months notice is NOT FREE, you're supposed to pay it. In law, it is called MENSE PROFIT. i.e payment in arrears of rent for the six months. The only reason why it seems to be free is that most tenants leave the premises before the expiration and the landlords dont enforce it. Other tenants pack out at night or when the landlord is not available. Other cases is because the landlord is unaware. For knowledgeable landlords, they even write you a formal letter of demand when you pack out if they know your address. ihedioramma: Lawyer go wan chop money. I am an estate surveyor, i have handled lot of tenant and landlord cases. No six months is free. It is just that our legal system is bad. Because most tenants abscond from properties during court cases and cant be found due to our poor system. Many lawyers are after their appearance fees. Them no go tell you the truth. 2 Likes |

Bro, usually bah, that 6months is given within your tenancy, so that at the end of the tenancy, you just pack your load and leave without any renewal. But if at the end of 6months which will automatically coincide with the end of your tenancy, the landlord backed by the court can throw you out. But if the court decided to have have mercy on you, few months can be given to enable you look for another apartment, but trust me, you will pay! It's called Mesne Profit. ihedioramma: |

@op, Let me break down this notice of a thing for you. First and foremost find tenant and landlord law and read to have a grasp of each parties obligation and also go through your tenancy agreement. Six months notice is given to a yearly tenant, definitely we know we hardly have weekly and monthly tenants in nigeria. According to lagos state tenancy law, a tenant is given 7days notice with the expiration at effluction of time. This means that if you recently just moved into the property, at the end of your tenancy they landlord is to give you 7days notice to quit. But once he collexts rent for the 2nd, 3rd and subsequent years, he is to give you 6months notice to quit. If your rent for example runs from january to december, at the end of december he is to give you 7days notice if he doesnt want renewal. This is why most agreements will say you write intention to renew probably 6months or 3months to expiration of your rent. So within this period each party can declare its intention to renew or not renew. So the landlord can give you notice to quit on the 1st of july to expire december. Since your rent has already expired, and he gives you notice to quit. You are supposed to pay for the six months and vacate the property except on his waiver of rent for the period. Once he waives that period, you become a tenant at will to him. If you prove stubborn and it leads to litigation. Once judgement is given, you are mandated by law to pay mesne profit from day one to the day possession is given by court, inclusive of all accrued utility bills owed even repair claims can be added if you spoil things in the house. Why people feel you dont pay during the notice period is because during court proceedings, most tenants Absconds and our legal system is bad. You dont mess up with rent abroad. They do monthly tenancy and once you default you are logged out of either electricity, water etc. And can be sued immediately. If you meet a landlord that has money to pursue court case, you wont find it funny. I have done so many tenant and landlord cases and i am telling you facts. Instead to fight, just dialogue with your landlord and sort things out. I dont know your location. Some landlords use diabolic or traditional ways to evict tenants and you know who will lose. All this people will not be there with you when the isse escalates. I have used court, i have used mediation centre and i hae also used traditional method to evict tenant. Please, nothing as sweet as peace. Than to be leaving your office to go and sit in the court room dragging something that has high probability to go against you in thr court room. #cheers 2 Likes |

oddessey007:I ve always advised my landlord friend to put his property especially rent collection in the hands of property managers but how do these property managers get paid ? For example 3 flats with rents 150 170 and 180 respectively what would be the percentage cut for these property managers, and if tenants violate or exceed these notice what will the next line of action for the property managers? Will they use force? Or the courts, if so, who bears the legal costs. |

OMOTOWO: Izza simple stuffzzz. Dont pay half, pay full year. Pay cash and ask him to come with his receipt or tenancy agreement before the cash is handed over. Once he hands you a receipt or agreement for extension, it automatically voids the quit notice since he cannot refund the money. However, he can still be smart in issuing you another quit notice to expire exactly as your rent duration. This will ensure you pay for full time you spend in his house. The best thing is to move out cause there is no trust in your relationship. |

The landlord's mind is just leave let me rent the house to another person and collect new agreement fees, caution deposit and rest of them. He might even rent it out on a new rental price to the new tenant. Biko pray not to meet a landlord that has time for court matter.
