I had the same issue with my Landlandy and if not that the guy stated his own as Landlord, I would say he is the second guy that we live together. I and a co tenant were severe d notice to quit in October and September respectively.
The six mnth notice is absolutely free.
You only need to pay for other bills aside the rent.

You actually should pay for the period you thought should be free.
As long as he gave you months to quit why you are not thinking of that sir you don't have to pay . Ask your self why the man gave him six months? Why not one month as you no the law ?

Oga, the six months notice is not free. No free rent anywhere. If he takes him to court and judgement is given in the landlord's favour, the tenant will pay mesne profit from day one till the day possession is taken.

Let him know that you're not interested in staying in the house any longer....pretend to have made provision for relocation even if you haven't. Pay him by march.

Please note, that the six months notice is NOT FREE, you're supposed to pay it. In law, it is called MENSE PROFIT. i.e payment in arrears of rent for the six months. The only reason why it seems to be free is that most tenants leave the premises before the expiration and the landlords dont enforce it. Other tenants pack out at night or when the landlord is not available. Other cases is because the landlord is unaware. For knowledgeable landlords, they even write you a formal letter of demand when you pack out if they know your address. If you don't pay, my dear, they bring an action against you for debt recovery

It is just that our legal system is bad. Because most tenants abscond from properties during court cases and cant be found due to our poor system.
Many lawyers are after their appearance fees. Them no go tell you the truth.

Oga lawyer, where you study your law from?The 6months given to get yourself another apartment is only where the Quit Notice is given impromptu, and it's never for Free! You go pay!Go read more on laws concerning "Recovery of Premises"

God bless you my noble colleague. I wonder where people got this idea about free 6months!All these Oluwole Lawyers! We Estate Surveyors seems to have better grasping of the law than these so-called lawyers.

Hi, I would advice you pay fully for a year if you like to live in the house, note that by paying the landlord a year rent nullify the Notice to quit, and please demand for your receipt immediately you pay him. Under the Lagos state tennancy law, once a rent is accepted by the Landlord for another year the quit notice becomes obsolete and null and void.
FYI, as a yearly tenant, You are only entitled to 90 days notice and not 6 months as you expected and afterwards 7 days notice of repossession of property. Your failure to comply might result to litigation.
I hope I made sense to you but the decision is yours to make.

Bro, usually bah, that 6months is given within your tenancy, so that at the end of the tenancy,
you just pack your load and leave without any renewal. But if at the end of 6months which will automatically coincide with the end of your tenancy, the landlord backed by the court can throw you out. But if the court decided to have have mercy on you, few months can be given to enable you look for another apartment, but trust me, you will pay! It's called Mesne Profit.

BY LAW ONCE YOU PAY THE RENT OVER AND ABOVE THE PERIOD OF THE QUIT NOTICE I.e. beyond March, the NOTICE ISSUED BY THE LAWYER AUTOMATICALLY becomes invalid. If he still want to eject you, he must issue a fresh notice.

ALSO NOTE that a Notice To Quit is NOT RENT FREE. Even if you are given a Notice to Quit, you are bound to pay till the last day you leave the apartment. I have always advise tenants on this. Owing a landlord and running away with his rent, is not been smart, it will come back to you except you don't want to be landlord.
NO LAW ALLOWS YOU TO SPEND A DAY IN ANOTHER 'S HOUSE WITHOUT PAYING, GOVERNMENT DID NOT BUILD FOR ANYBODY, SO THEY CAN'T MAKE SUCH LAW.

Let me break down this notice of a thing for you. First and foremost find tenant and landlord law and read to have a grasp of each parties obligation and also go through your tenancy agreement.

Six months notice is given to a yearly tenant, definitely we know we hardly have weekly and monthly tenants in nigeria. According to lagos state tenancy law, a tenant is given 7days notice with the expiration at effluction of time. This means that if you recently just moved into the property, at the end of your tenancy they landlord is to give you 7days notice to quit. But once he collexts rent for the 2nd, 3rd and subsequent years, he is to give you 6months notice to quit.

If your rent for example runs from january to december, at the end of december he is to give you 7days notice if he doesnt want renewal. This is why most agreements will say you write intention to renew probably 6months or 3months to expiration of your rent.

So within this period each party can declare its intention to renew or not renew. So the landlord can give you notice to quit on the 1st of july to expire december.

Since your rent has already expired, and he gives you notice to quit. You are supposed to pay for the six months and vacate the property except on his waiver of rent for the period. Once he waives that period, you become a tenant at will to him.

If you prove stubborn and it leads to litigation. Once judgement is given, you are mandated by law to pay mesne profit from day one to the day possession is given by court, inclusive of all accrued utility bills owed even repair claims can be added if you spoil things in the house.

Why people feel you dont pay during the notice period is because during court proceedings, most tenants Absconds and our legal system is bad. You dont mess up with rent abroad. They do monthly tenancy and once you default you are logged out of either electricity, water etc. And can be sued immediately.

If you meet a landlord that has money to pursue court case, you wont find it funny. I have done so many tenant and landlord cases and i am telling you facts. Instead to fight, just dialogue with your landlord and sort things out.

I dont know your location. Some landlords use diabolic or traditional ways to evict tenants and you know who will lose. All this people will not be there with you when the isse escalates.

I have used court, i have used mediation centre and i hae also used traditional method to evict tenant. Please, nothing as sweet as peace. Than to be leaving your office to go and sit in the court room dragging something that has high probability to go against you in thr court room.

Nwanne m, i have said it and will say it again. If you are not convinced go and read landlord and tenants law.

If it is abroad, you wont be saying this thing i swear. They sue for any little thing. I have a lot of experience in this tenant and landlord matter.

I ve always advised my landlord friend to put his property especially rent collection in the hands of property managers but how do these property managers get paid ?
For example 3 flats with rents 150 170 and 180 respectively what would be the percentage cut for these property managers, and if tenants violate or exceed these notice what will the next line of action for the property managers?
Will they use force?
Or the courts, if so, who bears the legal costs.

I got a quit notice in September (my rent expired 31-10-2019) and I am supposed to vacate the room and palour self contain by march 2019.

Today, my landlord called me and said why have I not come to make enquiry as to why I got the letter.

I told him I know the letter was from a genuine lawyer and I decided not bother in asking him why because I know why .

The reason is not far-fetched from the fact that I quarreled with him twice because of disconnected electricity supply for four days when I was not owing him. I actually fought with him for good two days. I dared him and his generation not to fix the light until I come back from office. The first I did, he didn't reconnect the light but he reconnected the second time .

The light was disconnected because some tenants who occupied other SCs didn't pay theirs. I actually told him to pay and disconnect others who have not paid because I am tired of this kind of monthly occurrence. Somebody like me pay very early. Then, he should have a way as a landlord of getting his money when he pays for everybody instead of every month disconnection.

To cut the story short, he said he has my type as son and there is no way such disagreement will not come to play. He said he didn't actually mean it that he was only threatening me. He said he asked for the letter to be written to me by his lawyer and then he has the right to withdraw the letter too. (I think he needs money and the man is thinking March ending is too long to get another rent for the SC)

He asked me when I am paying the rent. The rent is actually #140k but I told him I will try and credit him #100,000 first. When he dropped the call, I called my wife and explained what happened to her. She let me realize the man is trying to get the six month rent for the quit notice period of six months he gave us. She said we should not play into his hands. I actually remebered the man told me on phone that if I don't have the whole #140k now, I can pay half which is #70,000. This is where I discovered what my wife said might be true .

We are actually trying to leave the house before or by March ending as the notice read before this call.

I hope this man is not trying to play smart though I know we are to pay for the six months of the notice but I don't plan to give him until I am ready to pack.

Should I involve his lawyer because his contacts are written in the letter he gave me ?

Is my landlord real ? Is he trying to play smart to get money for the notice period early? Should I credit him the #100,000? What if he returns #30,000 and claim I only pay for the notice and he keeps dragging issue with me that the notice still hold? I can't afford to loose my #70,000 just like that because the money is for the new accommodation I am looking forward to get? Can I ask him to withdraw the letter first (may be in his wife and my wife presence )?

Lest I forget, my landlord extorts a lot. That's his hobby.

Izza simple stuffzzz.

Dont pay half, pay full year. Pay cash and ask him to come with his receipt or tenancy agreement before the cash is handed over. Once he hands you a receipt or agreement for extension, it automatically voids the quit notice since he cannot refund the money.

However, he can still be smart in issuing you another quit notice to expire exactly as your rent duration. This will ensure you pay for full time you spend in his house.

The best thing is to move out cause there is no trust in your relationship.

That landlord just left you on his own. That period you became a tenant at will.

The landlord's mind is just leave let me rent the house to another person and collect new agreement fees, caution deposit and rest of them. He might even rent it out on a new rental price to the new tenant.

Biko pray not to meet a landlord that has time for court matter. You were just lucky, don't feel it is your right and expect every landlord to be benevolent like your former landlord.
