The one-count charge read in court alleged that the suspect killed his brothers, Tunde Ayanleke, and Ayanbanji Ayanleke, for ritual purposes in a bid to become the chairman of a local government council.

According to the charge sheet, the suspect committed the offence on July 21, 2010, in Ipetumodu area of Osun State at 3am.

The charge sheet averred that the alleged offence was punishable under Section 316 of the Criminal Code, Laws of Osun State, 2004.

Musa' lawyer, Mr. Remi Ayodele, raised an objection to the allegation levelled against the suspect, saying that magic and ritualism were unknown to law.

Ayodele said the suspect had been in police custody since December 1, 2010, stressing that no charge was preferred against him until the date of arraignment.

He added that the two persons the suspect was alleged to have killed were his brothers, one of whom he trained personally and got a job for.

Urging the court to strike out the case, Ayodele pleaded with the court to stop the police from arresting Musa.

He also urged the court to order the police to produce the case file.

The prosecutor, Mr. Benjamin Akindoyin, objected Ayodele's request that the case should be struck out but agreed that the case file should be produced.

The Magistrate, Mr. Olalekan Ijiyode, ordered that the original case file must be submitted by December 8, 2010.

Ijiyode, who adjourned the case till December 9, 2010, also ordered that Musa be remanded in police custody.
