The Difference Between State Law and Federal Law

If you or somebody you love faces criminal charges, it's best to start doing your research to get a better understanding of the law and what you might expect in the process.

The essential way to start is to learn the difference between Federal and State laws. One area of law includes cases of felony, while the other deals with misdemeanor convictions.

Federal Law
The United States Congress created Federal Law. Legislation must be approved by both Congress's houses and signed off by the President of the United States before a law can become a federal one.

These laws apply to everyone in the country's 50 states, regardless of citizenship. The U.S. Constitution forms the structure of federal law by defining the power and responsibility of government, as well as protecting people's rights. If a person breaks a federal-level law, they face a conviction for a felony offense.

State Law
State law refers to the laws used by each State in the United States of America to govern its citizens. They are approved by the state legislature and put into effect upon signature by the governor. State laws apply only in their own State, but many states follow the same types of laws.

Not only do these laws affect citizens as well as visitors to the State, but they do also apply to corporations, business entities, and all other organizations operating within the state borders.
Whenever a person breaks a state-level law, they face the conviction of a misdemeanor.

Comparing Power
State laws are most often similar to federal laws, but sometimes they conflict with each other. As far as supremacy is concerned, federal law still prevails over state law, because the U.S. Constitution grants supremacy to the federal government over the State government. If there is ever a case in which both levels of the law are conflicting, the federal ruling will apply.

On the other hand, if the state law provides more rights to a citizen, it is presumed to prevail over federal law. Although state laws can give its residents more rights than federal law, they are not intended to lessen or restrict the rights of a U.S. citizen.
