Judiciaries are the guardians of the law. But whose law are they guarding in Africa? The current Western/Northern civilization is a creature maintained by the law. They write everything into laws, treaties, orders, decrees, conventions, and there is not one aspect of their authority that is not legislated. Even their evil deeds are legislated. The Take over and Destruction of African States was no different. The Law of the European was introduced in gradual steps ... First, agreements were signed. The most important aspect of colonialism was the signing away of control over land and territorial security by African Kings. Most of these Kings found the idea of lone European explorers offering them the "protection of the European Kings so fascinating that despite not being able to read and write European languages, scribbled what the European Mornarchs recognized as their signatures on treaties that decreed their take over. Even our African scholars till today use Western laws as templates when they get government legal drafting contracts ... so the cycle of colonization continues by our own hands.

African countries fall here: .... a state that remains under the protection of another state while retaining its independence is known as a protected state, different from a protectorate... That explains the presence of European militaries and spy agencies in Africa. Doesn't it? We are protected states. Protected by the relative colonial powers. The UN Declaration: International Obligations of African Countries Have you ever wondered why your polititians seem like Independence activists until they take office? Note how Article 74 which is supposed to be advocating for decolonization is preoccupied with the welfare of colonial powers and has no consideration whatsoever for the natives of colonial territories. Remember, this was in 1945 ... and still stands as is. Chapter XI Chapter XI zeros down on decolinization. The wording is interesting: (Article 74)
Members of the United Nations (who were basically the colonial powers) ... also agree that their policy (their legal relations with colonies) in respect of the territories to which this Chapter applies (all colonies that existed in 1945 - all African countries) , no less than in respect of their metropolitan areas, (Definition, dictionary: 2. relating to or denoting the parent state of a colony. "metropolitan Spain" So this refers to the relations between colonial powers in respect to colonial territories (The General Act of the Berlin Conference of 1985 indirectly referenced ??) must be based on the general principle of good-neighborliness, (well, well, well, maintain status quo!! Maintain the deliniative boundaries of the Berlin Conference please!!! Respect the Nile Treaty and other colonial agreements on European exploitation of African territories!! For the sake of peace with your fellow colonial "neighbours"... ) due account be-ing taken of the interests and well-being of the rest of the world (protect the interests of the colonizers ... No taking back stolen land, cattle, mineral rights, ), in social, economic, and commercial matters. (Respect all colonial agreements and policies on spheres of influence, protected territories and colonial interests (political, social and economic systems) So, did you expect that the colonial powers would invest in shipping, slavery, wars, genocides and looting just to call you to THEIR table afterwards and offer it all back to you? African Nations cite UN Resolution 1514 (1960) as giving colonized countries the Lee way to the granting of Independence. Nothing could be further from the Truth. In the United Nations. 876th plenary meeting,. 28 September 1960. 1513 (XV). Report of the Security Council. The General Assembly made a Declaration on the Granting of Independence to Colonial Countries and Peoples... Both of the resolutions refers back to the UN Charter (Analysed Above). Being legally scanty enough to leave the principles and definition of "decolinization" to Article 74 of the UN Charter; the maintenance of status quo ... We only got black leaders switching places with the white ones. Everything else remains .... The resolution also referred to the independence of these colonies being granted in accordance with their freely expressed (referring!!! ... Agreements, Treaties and Conventions) - see photo. Francophone Africa is the best example of these "freely expressed agreements". France, upon granting them "independence", made all her colonies sign the infamous French Colonial Pact. So why do we stay in the UN? Ask Ethiopia ... Having escaped the scourge of European takeover of the 19th Century, Ethiopia was free at the establishment of the UN. Ethiopia was hesitant to join the UN, with good reason. But the various UN organs and related Organizations control ALL aspects of international social, political and economic affairs ... With member countries being bound to collectively seclude non-members. So what next? The fall of the social, economic and political systems of the European? Let's watch the turmoil. Our Independence is on the other end of this tunnel that the world is now navigating.

All laws, local or International (agreements, treaties, conventions) are enforced by courts. About the European styled Judiciary in Africa ... The first court in British East Africa was established by the Imperial British East Africa Company in 1890 with A.C.W Jenner as its first judge. The British government had just imported various laws through the East African Order in Council of 1897 and the Crown regulations. The current European styled judiciary in Africa came with and for the purposes of enforcing the Imported Laws of the incoming European rule. We should stop here to note that all African pre independence States had their own systems of laws. There were various council and divisions within the societies that ensured smooth running of the society. The new laws of the colonial Masters were for the most part, a diversion from the accepted norms of the Local Societies. Laws that were overthrown in one day with various order in council in all African countries. Effect of the Legal Conquest 1. Loss of land and other property rights in favour of the new Masters... 2. Loss of authority of traditional dispute resolution mechanisms. Africans started seeking resolution of disputes from the new master. 3. Enforcement of colonial systems (non - compliance with taxes, removal orders, disobedience, rebellion could now be punished. 4. With the breakdown of self policing, the African society started disintegrating. Men were forced to find work to fulfill the new tax obligations, those whose properties in land and cattle were confiscated had to work for white settlers to fulfill their obligations to their families ... or face the wrath of the law that the judiciary enforced. Other vices began to sneak into African societies. Judges were so important, that the came before administrative technocrats (Governor's). The judges would later be used to punish, confine and even kill any opposition to the colony. The first local administrators we're also Magistrates. So We shall be free when Judiciary in the African society will be operating in these principles ... 1. Restoration of land and property rights to African societies ... 2. Recognition and support traditional dispute resolution mechanisms. 3. Replacement colonial social, economic and political systems with African styled ones according to our needs. Restore the principles of inclusion and consensus. 4. Restore traditional self policing mechanisms. This, the entire African Legal Society, past and present owes the people of Africa, after faithfully imposing the yoke of colonialism on the African society for an entire century ... |
