Babako's Lawyers in a desperate move asked the court to transfer the investigation in the case they instituted against the Honourable Member representing Edu/Moro/Patigi Federal Constituency.

You may recall that the Court ordered investigation into the matter and refused to prosecute Hon. Ndakene as pleaded by Babako's Lawyers. The police, who had since commenced investigation into the matter asked the Court to give them additional one week to complete their investigations.

Babako's Lawyers however objected to this, citing contempt of court on account of the inability of the police to produce the report of the investigation. Babako, in a bid to further waste the time of the Court and prolong this matter in court, asked for the transfer of the case from Utako Police Division to a higher Division.

Ndakene's Lawyers who berated this approach referred the Court to the provisions of Section 36 of the 1999 Constitution of the Federal Republic of Nigeria (as amended) and Section 1 (1) of the Administration of Criminal Justice Act (ACJA) 2015, which emphasised the need for fair hearing and substantial justice. Ndakene urged the court to discountenance the application by Babako and grant the request by the police to submit their reports.

One would wonder why the complainant (Babako) is in desperate mode. Could it be the fear of the repercussions of bringing false allegations against a Legislator in a bid to distract and drag him in the mud? Could it be that Babako needed more time to perfect another nefarious scheme?

Babako may have landed himself in a legal logjam he may never recover from. You cannot lay false allegations against a person and try to truncate investigation into the spurious and baseless claims.

The court adjourned the case to the 6th day of July, 2020 for ruling on Babako's applications and police report on the investigation.
