PDP conducted his primary but INEC has not released the list of contestants in the forthcoming election.In view of this the petitioner is right to present his petition after the INEC publication of contestants.The INEC publication is an indication that all primaries have been completed .2. Wole Olanipekun will also present this case at the tribunal only IF Obaseki wins . 3 As I said yesterday the SC judgement on Degi in Bayelsa is a bad precedence for Obaseki.The apex court held that when there are persistent inconsistencies in names and qualification's of candidate the integrity of the person is questionable even if he has countless affidavits to support them In view of this, Obaseki has a lot of questions s to answer now. ejimatic: The issue of Degi here doesn't apply because Degi refused to name the rotary public that gave him multiple names. NYSC has admitted their mistake... UI has affirmed he was their student. ..when there are persistent inconsistencies in names and qualification's of candidate the integrity of the person is questionable even if he has countless affidavits to support them In view of this,..You didn't complete it..when not backed by a recognised notary public or the certification body. The case is more or else like Lawrence's than Degi's. The issues of 2016....I don't have a full grasp, I don't know what he submitted then (many can't help me here on NL)..that's why I don't intend to discuss the substance of the case. The publication by INEC was June 30, did you know when this was filed? Helping with that info will go a long way. |

fergie001:. 1 The truth is there are irregularities in Obaseki qualifications.All his affidavits were rejected in 2016.He has to explain the reasons for them. The court will decide on this matter. 2 I don't know the date of APC petition against Obaseki if it exists anyway and neither do I have access to the petition except what I saw online. If the date of the petition is after. June 30 the petitioner is in order as INEC will be one of the defendants in the case. 1 Like |

fergie001: “Section 31(1) of the Electoral Act, 2010(as amended) makes it mandatory for political parties to submit the names of candidates they intend to sponsor for governorship election in Edo State to the commission 60 days before the date appointed for the election. In compliance with INEC timetable and schedule of activities as well as section 31(3) of the Electoral Act, the commission published the personal particulars of the candidates in the INEC office in Edo State. “The essence and implication of the publication is that any person who has reasonable grounds to believe that any information given by a candidate in the affidavit or any document submitted by that candidate is false may file a suit at the Federal High Court, High Court of a state or FCT against such a person seeking a declaration that the information contained in the affidavit is false. “By Section 31(6) of the Electoral Act, if the court determines that any of the information contained in the affidavit or any document submitted by that candidate is false, the court shall issue an order disqualifying the candidate from contesting the election.” 2 Likes
