But the house assembly has been locked for renovation by the state government for over a month. The deputy speaker can act on behalf of the speaker which we should look at . The simple thing is that the PDP miscalculated and the case you sited has been withdrawn.

We are talking about law here. The case has not being redrawn I don't know where you got that information. Let us stick to what the law says.

''Main while there is a supreme court judgement which says swearing in can only take place within the confines of the house of assembly''

Go and read the judgement again.

What happens when the house of assembly is not accessible?

The law is the law.

The part l highlighted in "red" in your post, is PATENTLY FALSE.
The Courts have affirmed that the Governor cannot dissolve or sack ordinary Local Govt Chairman, because they were elected by the People, not appointed by the Governor, how much more State lawmakers elected in a general election!
undecided

Is like you think the "Executive" (an arm of the tripartite of Democracy) can dissolve another EQUAL BUT DIFFERENT ARM of Govt?
It does not happen, he will need an act of parliament to do that and ldont see the Legislators voting that the Executive should dissolve them. undecided

little boy - although not a popular route in modern politics, the executive can dissolve the legislative arm and call for fresh elections as well the legislative arm can impeach the chief executive who is the governor while the judiciary can interpret executive or legislative activities as ultra vires (unconstitutional) - that is how the organs of government watch over each other to check abuse of power - did u do government in school? grin

ok if the legislative arm is all powerful and they can do and undo

we know how the judiciary checks on the government - interpreting the law by giving court judgement
we know how the judiciary checks on the government - making laws and impeachment

HOW DOES THE EXECUTIVE control the other arms of government ?

The Chief executive can fire (by retiring) and hire members of the judiciary - you already see what Buhari did to Onnoghen so no need to explain
The Chief Executive can dissolve the legislative arm and call for elections - discretionary powers - you do not use this EXCEPT you are sure of victory

IF PUSH COMES TO SHOVE - obaseki after re-election will dissolve the house of assembly by proclamation and call for elections in 90 days

the down side of this move is IF the same law makers win and return - then he is in for trouble - BUT if he campaigns ruggedly against them - he wins

and then have his newly elected loyalist in PDP will help him rule effectively - go read your constitution and stop acting on impulse on nairaland

So Obaseki will just wake up one day, dissolve a whole state house of assembly then.issue a new election?

Obaseki coasting to victory 100%.. this drama just sealed his victory at the polls.

The game plan has changed to "take down Oshomole" for the Edolites, like it was for anenih in 2012 when Oshomole was the underdog from NLC.

Obaseki had better use this underdog strategy efficiently, one error usually takes it away..

If you are in doubt, re-study Lagos Governorship election 2015 and why APC only won with less than 100k votes despite being Tinubu's strongest hold...

The bigger Question is: Where they LAWFULLY ELECTED?
The answer is YES.
So, if Obaseki refuse to inaugurate them in the last four years or so, does that invalidate their being lawmakers?
The answer is NO.

So, if they are lawful lawmakers, they can act in that capacity, irrespective of the evil game Obaseki is playing because they represent the people who voted them to make laws for them, not Obaseki.

Since they refused to make themselves available to be sworn in as legitimate members of the House, they can make laws in a beer parlor and even impeach the Governor as many times as they wish in a beer parlor but their activities must remain in a beer parlor.

Oshomole with his stooges know their limitation otherwise they would have embarked on this step long before now. This is an idea of the Igbo Supreme Court Governor who thinks he is a maverick. It lacks maturity and just won't wash. He is starting a line of fire that will burn all the way to Owerri and consume him.

Why Obaseki didn't allow 17 elected lawmakers to be sworn inn before?

For those who don't understand Politics...

These are the implications of the development:

1. Victor Osadero 19-Men Assembly are recognized by the Federal Government, which through the police, army etc implement the law.

2. Every resolutions of the new speaker carries the weight of Law.

3. No Bank will give Obaseki Loan Without the resolutions emanating from the new Speaker led Assembly..

4. They can initiate the process of impeaching Obaseki if they so desire...

Plus obaseki will have to give proper account on how he has spent the state's resources so far.

Una go just open mouth talk thrash anykindway. Two days ago Oshiomhole was not a godfather. That has changed.

He calls the shots now.

All political power resides at the local level. Oshiomhole controls Edo House of Assembly now.

Im a MAN...I would never fight like Obaseki did.

Ambode is more of a man than Obaseki.

Watch.....Wike is going to be super mad at Obaseki. PDP stepped down their candidate for Obaseki. Whats their gain?

From the comments one read here, it is obvious there is no hope for Nigeria. Given the hardship and bad governance in the country, how on earth is it still possible for people to be supporting the APC or the PDP?
