That was corrected in Section 285 of the 1999 Constitution as amended.

That very provision will suffice

If you want citations, let me know.

That means inec now has powers to exclude and disqualify?

Why did INEC refuse Zamfara APC to submit names of their candidates in 2018?

There was no primary according to inec which is constitutionally required. A court restored apc until it was proven that inec was correct

This is laughable.

What are the prayers of ANDP?
The ANDP was after its exclusion and not proving if its candidates were validly nominated or qualified.

Bottom line, INEC has no power to disqualify or exclude a party from participating in an election because it doesn't screen candidates of parties contesting an election.

Nigerian judiciary is a mess.

so if a political party presents a "new born baby", inec should overlook ?

Did INEC have the right to do the job of the Court according to you since it was a constitutional matter?

It is settled law that the powers to exclude or disq lies with the courts not inec....

I knew from the beginning that there was no case here at all,you can't go to tribunal when you didn't participate in a election, because in tribunal you on only contend the outcome of the election

INEC has guidelines yes for sure, but powers to disqualify no it doesn't.

It has been stated clearly by the Apex court that INEC has no power to disqualify or exclude a candidate or party from contesting an election.

I think I will go with this opinion, of my learned counsel brother grin

It is the same thing we discussed earlier.that nomination you referred to will refer to covers both disq and exclusion.therefore if tribunals are legislating on disq, there's no wat they wouldn't include exclusion....even if the andp case is dead,I want you to agree that the tribunal has jurisdiction...

Finally, let us settle it easily.the supreme court in bayelsa 2015,Adamawa 2019 and recently in kogi dealt on matters of exclusion.find out what they exactly said...

The South South is now 100% PDP, but the truth remains that a political party platform has no significant effect on how a governor chooses to develop his state. If not for the sake that many Nigerians are obsessed with party loyalty, performance from leaders is what is uttmost not which party has won or lost. Congrats to Gov. Diri.

Your first sentence gave you away.
The remaining ones are emotional blackmail

The SC will help us distinguish between Disqualification & Exclusion!

In Kogi 2019....the SC never brought up the issue of statute-barred or not but just valid or invalid nomination.

Adamawa 2019.....Help me with the case.

Again....don't let us lose focus on this case, the ANDP were informed they had an invalid nomination since Sept 27, 2019 & they did nothing about it until Feb 26, 2020. Isn't that erroneous?

PS: It is something like this that made Ize-Iyamu file his as pre-election.

That was an error on the part of ANDP

What they should have done is approach an high court

Because if they are niw saying that INec erroneously disqualify them.

1. They Fielded an under age

2. Inec lettered them of the need for them to replace such.

3. They complied by replacing but this time around fielded another under age

4. Inec informed them again this is another under age

Stop this rubbish.... INEC has what they call delegated legislation which allows it to enforce electoral laws such as concerning age limit and so.... Why then do candidate have to submit those relevant documents especially the ones that has to do with age and all
