Surprisingly, the HR is not been questioned for not doing due diligence. They just instructed my brother to go home that the offer was in error.
Just go to the nearest public complaint commission in your state and file your complaint. They will advice according. You don't need a lawyer yet. Anybody can apply for any post if you feel you are qualified. Its left for the HR to do his job diligently and screen. Good luck!

oga after shouting prayer up and down hope u know God doesn't do illegal things.. the employment was for staffs/interns and he wasn't. He used I know branch manager to get the job he wasn't qualified for based on he wasn't a staff and your shouting prayers control 4 knees.. Any way I wish him the best not like am happy his now jobless

The mistake was not his but the person that recommended him.

Just like someone said, if they had issued a sack letter, it may technically exculpate them but not completely.
Important did he sign an employment of offer letter? And what are the terms. This, to a great extent will determine the above.

You are the one who actually has little understanding of the implications of his brother's actions. The dude deceived his interviewers with the help of his former manager. HR only found out after employment letter had been issued. I am sure HR probably went through his records because someone amongst disgruntled applicants (staff) rightly raised dust over his recruitment against standard company criterion.

As it stands, the dude has zero ground for contesting his sudden disengagement. In fact the company could sue him for mischief and false representation. I am sure the said manager who encouraged this mischief would be in soup as we speak. He will no longer be trusted on matters like this.

We are talking about a managerial position here, not any position. Hardly does a reputable company recruit an outsider to fill up a managerial vacancy. Very uncommon.

Thanks for breaking it down in basic terms for those still arguing.

Fighting his sack would endanger the job and prospects of the magnanimous Manager.

What if the brother fights his sack unsuccessfully and then gets the manager too sacked ?

I wonder how pleased the manager would be then.

sorry it happened this way.
At this point,he doesn't have much arguement to make,rather he should see tge manager wgo recommended him and see if he can help.Even if it isn't for the same job,for another one.

This is so sad,
I remembered similarly situation happens a man in 2018 in one of this oil services company in PH. The man got d job during d interview d man told the HR head, HR Manager and other panelist that if d position isn't parmanent they shouldn't employ him coz he is still fine in his present company. So the HR head promised him that he will be manager and the position is permanent. So he was employed and he man resigned from his company a week later the HR head when to his formal company to do a background check and asking a lot of his formal colleagues questions and few days later he called this guy and said he can't be a staff of the company and that was how the man lost two jobs in one week.

About 2 years ago, my brother started working for this company as an intern. The agreement with his manager was that he will be confirmed within 6 months. After about 18months without confirmation, he resigned from the job but still kept contact with people from his former job.

Fast forward to some weeks ago, he heard that his former company needed personnel at a new branch in a new state and it's strictly an internal recruitment. So he met his former manager and expressed interest, the manager pushed his name (eligibility is dependent solely on recommendation by your branch manager) and he alongside others went through series of interviews at the end of which he was employed. Suffice to say that the HR manager was part of these interviews.

He was sent an offer letter plus other documents and he resumed last week monday. Last week Tuesday, he was called by the HRM who asked him series of questions after which the HRM said he didn't know all this while that my brother isn't an active staff and that he (the HRM) was hoodwinked by the branch manager. His argument was tgat there were other eligible candidates who could have been recommended, but the manager brought someone from outside.

Now, the offer letter to my brother has been withdrawn. Same guy that resigned his job the moment he received this offer, he has even told everyone that mattered tgat he was relocating.
Please is there anything we can do to salvage this, it's so heartbreaking. I don't know where they expect him to start from when he gets home.

U broke the protocol so u are clearly at fault and can only appeal for sm type of consideration on whatever grounds and in this case it will depend on who u know. Ideally it’s an internal recruitment and they have a well organized HR.

The moment you brother resigned from the company, he ceased to be a staff of the company. Since the recruitment was meant for the internal workers, he was not qualify for the interview, let alone appointment letter. As at the time he was going through the screening the HRM was not aware of his status as ex-staff. Therefore, your brother has no prema facie case against the company.
He should just retire to GOD's hands and pray for better offer to come.

I don't understand what most of the people here are saying.

If your brother knows he never lied about his status in the company all through the interview and recruitment process...then my friend, he has good legal grounds to approach them for compensation especially seeing that he has suffered double loss.

However, he might be putting his former Manager and HR guy in a truckload of trouble cos they goofed.
He has no legal ground to sue the company. The role is reserved for active staff members of the company. It's a job only available to insiders.
He shouldn't have known about the job opening in the first place, talk more of applying.
Let him go to the Supreme Court, he case would fall down flat.

Now this is the difference between Ethics and religion.
A reason why despite being assumed to be a "deeply religious" country, Nigeria still is one of the most corrupt countries in the world.

We've been so blinded by our perceived religiousness that we selectively perceive the truth the way we wish.

A vacancy was announced, where it was explicitly stated to be an "Internal Vacancy". A vacancy for staff only. The fellow knowing fully well that he had resigned from that organization and was already employed by another organisation, went back, influenced a manager to push in his application (sin of cronyism) as an insider (a simple definition of fraud, is the misrepresentation of facts for the purpose of material gain) and got the job, depriving other true employees of that position.

When the fraud is discovered, all modicum of penance and sacrifice is thrown out the window.

Sin is sin please.

Let's quit this distortion of morality and ethics. It'll take us nowhere at the end.

He must not necessarily mention the manger. All he knows is that he was offered a place and he had accepted and relinquished his means of livelihood.

So sorry that your brother’s offer letter was withdrawn. This would be tough for your brother however he needs to pick himself up and keep trying. For him to go through a recruitment process and beat other contenders shows he is capable of getting another one. He should look forward and remain focused on his career. Someone already suggested he goes back to his previous employer with the hope they take him back; it is worth trying. However, he should not push this particular issue any further. This can get the Manager that tried to assist him sacked, that is if hasn’t been sacked already. This is a sackable offense (integrity) which can be worsened by your brother pushing the case any further. He obviously means well for your brother and your brother should repay his kind gesture by not pushing this any further. I wish him the best as he continues to push further in his career. Cheers.

HR personnel from different companies communicate with each other. Especially when an employee is quitting a good job to join a better company.

Whatever you do, don't have any issue with your managers and HR staff. They can fvck you up in your current and the next job.

Ps - Nigerians are naturally wicked, imagine what a Nigerian with power would do to you.
I had a video interview with a silly H.R staff that wanted to recruit me for corporate sales executive when I applied for a lease executive, the lady was so rude that I had to call her to order letting her know she wasn't talking to a child and cut off from the video interview. My friend was telling me that she can make sure I never get a job again, you think that is possible?
