good day nairalanders, please am here to seek advice on behalf of my younger brother.

my brother was working for a company for close to 2years now, during resumption he was made to understand through his appointment letter that his salary was subject to statutory deductions, which includes tax and pensions, 8% and 5.3% has being deducted from his salary every month as pension and tax respectively,a pension account was created for him, but only once for the past 18 months that account was credited, when ever he ask why the pension is not remitted ,they will tell him there is no money for that at the moment,

now things has gone so bad that he needs to resign from the company, on his appointment letter it was clearly stated that you resign with one month notice or in lieu of one month salary,

last week he submitted his resignation ahead of next month, upon submission of the resignation he requested for tax clearance receipt ,which he intend to use to know if the tax was actually remitted, to his surprise ,he discovered that the tax was not also being remitted, but all had being deducted monthly from his salary,

he inquired about his pension, they told him they will remit it,

my questions are:

since this taxes were not remitted, can he request for the money alongside his pension to enable him start up something,

if they insist on remitting it to the revenue board, why not all this while,

will a legal action be effective incase they refuse to give him the tax money and the pension.

note:he is resigning on due process, just that there are ups and downs that he can no longer cope with couple with he wants to start up his own business.
please your kindid opinion will help us here.

Write officially to the company requesting them to provide you with evidence of tax clearance/remittance. If nothing is done within a stipulated time, write to tax authority referencing the the letter you wrote to your company.

Do the same as regarding pension but the second letter should be to PENCOM via mail.
