Hmmm...... at times you work in these companies... they are sold several times and you wouldn't know until you see a different paycheck... or letterhead... but everything else remains the same. I believe the union should be fighting to ensure that if sold.... the new company would honor the existing contract.

This is just blackmail premised on flawed laws.
Labor law as quoted by the workers say there is no gratuity again. It's been replaced with a pension.
If you can't work with the new owners, resign and get another job.
Where do they want to be "paid-off" from?
The new owner is even interested in working with them because they are experienced. If they all get paid off, will they retain their jobs and still collect salary?
If they are paid off, who will work in the business?
Honestly I think this is insensitive on the part of the union leaders pushing this agenda.

The workers are being greedy. Shoprite is not terminating any worker. Yet these ones want to be paid to quit. If they are all paid to quit who will then be left to do the work??

you will be left there to do the work.

Think about it, the workers are not being fair. They want to be paid - not to stay and keep working, but to leave and go to a competitor or start a biz and start competing with Shoprite!

If the labour law supports their action, then so be it. You don't know how the new management is going to run their business. Let them be paid off first according to the law and if any of them is interested in continuing with the new management and if the new management is also interested in retaining some of them, they can renegotiate then. That's how it happened in the power sector

You dont get it, if the transfer is made, the new owner will ask dem to reapply, cos they worked for shoprite and shoprite is no more, so they loose all the benefits they wia entitled at shoprite and start afresh.

Their aim is since shoprite is leaving, settle us terminate our contracts pay us off. Then if the new owners advertise for employment they can apply if they wish

the workers are fair, first - they are no slaves, their contract is of employment and not slavery which gives them liberty to quit at any time.
secondly - what the are fighting for is their right, entitlement and benefit. at the expiration of the contract with the company they are meant or entitle to it.
don't forget that deductions were made from their wages while still in service with organisation as such they are entitled to their severance package which is the standard world over.
leaving don't mean there won't be no one to work or replace them, there are thousands of unemployed Nigerians who will joyfully replace them so why force them to stay when they felt like no more interest?
leaving for competitors in Nigeria!? I doubt that, shoprite seems about the largest mall around Nigeria more so no competitor would muscle the strength to employ everyone parting with shoprite.
on establishing a competitive mall is a fair business approach (competition is allowed) in as much Nigeria is running a capitalist economy system. if you will come to think of it this workers don't have what it takes to compete with shoprite all 'em put together.
they should be paid off that is the fairest thing that could be.

The real tragedy isn't the striking workers. It is that a Blue chip foreign investor is departing Nigeria. It does not speak well of the investment climate here. The pitiful growth rates of less than 2% since 2015, Buhari's forex controls and the madness at the ports is enough to drive anyone out.

Since the contract is not terminated, I think it's good for them to continue with the new employers, provided no cut off salary

It is expected that many workers would be sacked after new management takes over. Besides, present staff does not know details of mou between old and new management.

You sound insensitive. Probably you're one of the senior staff/small investor benefitting from ShopRite.

They are using the Law to their advantage. Whether they quit or not should not be your headache. Repeal or review the Law first!

It doesn't make sense to transfer workers to a new employer. The workers will just be at their mercy. Their peaceful protest is welcome.

God help the workers of Shoprite. They sold.to some wicked exploiters knowing full we'll that in South Africa this nonsense cannot happen. Why are the Nigerian buyers hiding.Publish their identity you will see how far this country has gone down the path of man's inhumanity to man. God help the toiling labourers in this land.

Don’t just come online and type rubbish pls...If you’ve ever done such jobs you’ll know that once theirs a new owner, the employees will be asked to reapply with terms and conditions. The employment will be outsourced and most of them won’t get the job.....
