Another political party, Hope Democratic Party Monday filed a petition at the Presidential Election Tribunal praying the court to nullify the presidential election and set aside the Independent Electoral Commission’s declaration of Dr. Goodluck Jonathan of the Peoples Democratic Party (PDP) as the winner of the election.

In a petition filed by the party at the tribunal, HDP said the conduct of the presidential election did not comply with the Electoral Act 2010 as amended and the 1999 Constitution.

The party claimed that its presidential candidate, Chief Ambrose Owuru had over 30 million votes allegedly cast for him which were allegedly diverted to the PDP.

In the alternative, he prayed that these 30 million votes diverted to the PDP be returned to him and he be declared the winner of the election.
The party said that INEC did not comply with the provisions of the constitution and the Electoral Act which required that election be held on a stipulated date.

It said, :”Your petitioner states that on Saturday 16th April, the presidential election legally scheduled in the Electoral Act to hold on the 9th April 2011 was rather purportedly held throughout the Federation and result declared on the 18th April 2011 with 1st Respondent (Jonathan) as the winner.” The party argued that for INEC to select another date other than the 9th April for which the presidential election was originally scheduled, it ought to go back to the National Assembly to effect necessary changes in the dates.

It further argued that for the shift in the date of the presidential election to be valid, there must be evidence of crisis, breach of peace or any natural disaster.
