• Embattled DCP ordered to respond to allegations
There are strong indications that the Police authorities may not hand over the Commander, IGP Intelligence Response and Monitoring Team, Abba Kyari, a Deputy Commissioner of Police, to the United States for criminal prosecution.

It was gathered that the battle to extradite Kyari to the US for trial for alleged involvement in a $1.1m Internet fraud would be fought hard at the courts.

Already, the DCP has been advised to constitute a strong legal team to challenge and, possibly, frustrate the extradition request of the Federal Bureau of Investigation in court.

An FBI criminal complaint lodged at the United States District Court in California had listed Ramoni Abass, alias Hushpuppi, and Kyari among six suspects indicted in a $1.1m international fraud conspiracy.

The other suspects include AbdulRahman Juma (Abdul); Vincent Kelly Chibuzo (Kelly); Rukayat Motunrayo Fashola (Morayo); and Bolatito Tawakalitu Agbabiaka (Bolamide).

Kyari, who is popularly known as ‘super cop,’ had been under fire since the FBI Wednesday released a 69-page court document showing that he had been under investigation by the FBI for his alleged link to Hushpuppi, who had pleaded guilty to fraud.

In the case marked 2:21-cr-00203, USA VS Abba Alhaji Kyari dated April 29, 2021, the FBI asked a US District Court in California to order the arrest of Kyari for 10 days.

The US Department of Justice in a statement said Hushpuppi admitted during interrogation that he paid bribes to Kyari to have one of his rivals arrested and jailed in Nigeria following a dispute over a $1.1m fraud involving a Qatari businessman.

According to the FBI, Hushpuppi asked Kyari to arrest “co-conspirator,” Kelly Chibuzor Vincent, after both were involved in a dispute over the $1.1m scam.

It was stated in the court document that in September 2019, Kyari travelled to Dubai and was picked by Hushpuppi’s driver.

Sunday PUNCH gathered on Saturday that Kyari, who had earlier denied the allegations in social media posts on Instagram and Facebook, had been ordered to respond officially to the FBI indictment.

Our correspondent gathered that Kyari was given a few days to tender his defence.

Sources explained that the DCP was also advised to get a strong legal defence team to assist him on the matter.

A source said, “The battle promises to be long and full of legal fireworks, but it is not certain that the Police authorities would readily hand over Kyari to the US for trial.

“Will the FBI allow any of their officers to be extradited to Nigeria for criminal prosecution?

“Kyari has been advised to get a vibrant legal team to fight the extradition request and the team is expected to start work immediately.”

Recall that the Inspector-General of Police, Usman Baba, had ordered a review of the allegations against the IRT commander.

The Police Service Commission had also said that it would determine Kyari’s fate and not the Police leadership.

The commission noted that Kyari might face dismissal or demotion, and prosecution if found culpable of the allegations.

If the principle of justice is to be upheld, it shouldn't be a matter of fighting extradition request. It should rather be a matter of the Nigeria government investigating if the charges levelled against him are true. If yes, then quietly hand him over for prosecution, but if no, that's when the fight against extradition becomes reasonable and justified.

Poor governing system would not allow for due process.

In as much as we all don't like and support what Abba kyari does, one thing is no right thinking country will extradite is citizen to another country to be prosecuted. Not even the rank of Deputy commissioner of police. At most he should be prosecuted here.

Did Nigeria ever hear the side of story of the thousands it has been extraditing at the call of FBI

When other Nigerians were arrested Nigeria told them to hand themselves to USA directly or else they come do it for FBI

Nigeria never bothered taking their sides of the story

This is not village matter where one person will talk then the king will now listen to the other person.

This matter involves evidence and that is what the u.s court has used in signing a warrant.

Now the other person should go and defend himself with evidence too.

FBI (Nigeria senior partners) are the ones who carried out investigation on Hushpuppi

They traced out every thing concerning how the fraud went

Hushpuppi isn't the one telling them who to arrest, all his collaborators are there in the findings

We want to hear from the accused, he should go to the competent court handling the case, hushpuppi isn't court

If I'm correct, the same PSC dismissed a female Southern Officer from Ekiti sometimes back for getting pregnant while still single. Now a Northerner is indicted in wire fraud, they are running from pillar to post to save him and his job.
Southerners are still asleep with the kind of things going on in this country.
If it was a Southerner caught in wire fraud, EFCC would have paraded and bundled the person to face trial in US but now that a Northerner is involved, same rule no longer applies.
