Temidayo Akinsuyi, Lagos

Muiz Banire, a Senior Advocate of Nigeria and former National Legal Adviser of the ruling All Progressives Congress (APC) on Sunday said an internal implosion is imminent in the party owing to recent developments which relate to the legality of the National Caretaker Committee headed by Governor Mai Mala Buni of Yobe State.

Speaking in an interview on Channels Television ‘Sunday Politics monitored by DAILY INDEPENDENT, Banire also faulted the decision of the Buni-led committee to proceed with the ongoing ward congresses when the Supreme Court ruling on the Ondo governorship election is not yet clear.

He said if indeed the Supreme Court ruled that Governor Buni’s position as APC caretaker committee chairman is illegal and he shouldn’t have signed Governor Rotimi Akeredolu’s forms, then any action was taken by the committee and the ones that will be taken in the future will be considered illegal.

“Nobody has seen the full judgment of the Supreme Court, the expectation is that by tomorrow, the certified true copy will be released for people to digest and now be able to make informed decision and opinion. In such circumstances, why will they be proved with the congress?”
“ Why are they in a hurry to do something which eventually might end up being calamitous? If eventually, it is the truth that the Supreme Court came to the conclusion unanimously for that matter that Governor Buni ought not to have signed any of the nomination papers of Governor Akeredolu, the same thing will apply to the congress they are doing”.

“This is because the letter of notification to INEC was equally signed by Governor Mai Mala Buni. If the foundation is lacking, certainly they can’t build anything on it. At the end of the day, the whole exercise will be a nullity. It is a complete waste of everybody’s time”.

“For me, the least I can say is that the exercise is just simply reckless. I do not want to use the word irresponsible. Even without necessarily looking at the Supreme Court judgment, I will say that as of today, if you go by Article 17(iv) of the APC constitution, it is very explicit”

“There is no way the Caretaker Committee can do anything that will not amount to a nullity. Every step they have taken so far, the ones they are taking right now and the ones they will still be taking is ultimately likely going to be a nullity. Why do you want to go in that direction? So, for me, I have predicted it. I hope I will be disappointed that certainly internal implosion of the party seems to be inevitable imminently”.

Bagudu, Buni, Malami, Amaechi, etc should just accept that the game is abruptly over. Tinubu's camp is back on level ground.

So all PDP needs to do is to go to the SC to declare that it is illegal for a governor to hold the position of chairman of a party whether in caretaker or acting role and Gbam!! implosion complete.

That garfield1 is talking out of ignorance, he knows nothing about Politics, I keep on schooling him yesterday but choose to be stubborn.

Moreover, there's nothing like the position of caretaker chairman in APC constitution so I don't know why anyone with right thinking sense will think the position of Buni is legal apart from been contradicted to section 183 of Nigeria constitution. Malami and those greedy Governors will set this APC on fire because of his 2023 agenda, I don't know why Buhari is still aloof on this matter by now. I see PDP hitting it hard on this issue after 2023 if APC seems to be stubborn on this issue.

I am with Muiz on this. There must be an ulterior and deliberate motive on Buni's part to destroy the party's chances of winning the 2023 general election, perhaps to favour a Northern presidential candidate of the opposition party. Because his caretaker committee's stubborn insistence on going ahead with the congress (in light of the recent supreme Court ruling) makes no sense whatsoever. It would have cost them nothing to postpone it.

Going forward, it is for them to know or not to know. By this judgement, Uba is wasting his time in Anambra.

PDP cannot do anything now because the issue has become statute-barred.

Which issue is statute barred?

PDP cannot sue APC over the internal affairs of APC. This is a settled position of law now.

The entire caretaker committee should be disbanded immediately and the recently conducted ward congresses canceled. There is no point progressing in error when there is still enough time to do the right thing. Malami and his sidekick Buni should stop the grandstanding and err on the side of caution in the overall interest of the party.

What Malami is doing is deliberate. He and Buni know what they are doing. They are acting for the North.

1. Malami ensures that APC makes fatal mistakes.

2. APC presents a candidate from the South, PDP presents a candidate from the North.

3. The entire North will vote for the PDP candidate because he's a Northerner, but he will lose.

4. Apc wins but the PDP's candidate who is a Northerner will be declared winner by the courts.

This is the first time both President and party chairman are from the same region. They are planning to retain the Presidency post-2023.

I said it earlier that PDP counsel are somehow dum** they ought to av wait for the conclusion of the Congress even wait after 2023 election and drag them to supreme Court. They might win back the presidential election by technical means but sadly APC might make an amendment now if those greedy Governors bring down their ego together with Malami that's even unfit to be a charge and bail lawyer that was saying trash yesterday.

They can't.the supreme court has settled this severally

Any product of such illegal internal affairs will be mincemeat for PDP's lawyers. Not the process per se, the product of the process.
